A few things to remember: • In order for ballots to be opened, a quorum of 25 percent of the membership MUST cast a ballot. PLEASE REMEMBER TO VOTE! • Earlier this year when planning for the Annual Election, Solera Diamond Valley did not anticipate having three open seats and ONLY having three volunteers apply for a seat on the Board. By the time, the Election process had begun the contract with the Inspector of Elections had been executed and the opportunity for voting by Acclamation had passed. That is one of the reasons SDV had to go through the whole election process. Further, HOA Legislators in Sacramento added a new step to the vote by Acclamation Nomination process which required additional notification to the membership. • Also, not only are you casting a vote for the candidates running for re- election, but you are also casting a vote on the IRS Revenue Ruling (70- 604). If the Association spends less money than budgeted and there are excess funds at the end of the fiscal year, the membership must approve the transfer of the excess to the next fiscal year to avoid being taxed on it. A 'yes' vote will give the Board approval to use any excess funds in the next year's operating budget. A majority of the votes cast must be yes for this measure to pass. • Ballot envelopes must be signed by the owner to be counted. • Returned ballots must be received in the envelopes provided by the inspector. • Ballots may be returned by mail, by certified delivery such as UPS or Fed-Ex, or by hand delivery to: The Ballot Box, 3315 E. Russell Rd #A4- 156, Las Vegas, NV 89120. • The deadline for the receipt of ballots is 12 pm (noon) on Nov. 8, 2022. • Ballots will also be accepted at the Mountain View Lodge on the day of the meeting ONLY on Nov. 10, 2022 and must be handed to the Inspector of Elections between 10:45 and 11 am. • If quorum is not met, we will reconvene at an additional cost for the Inspector of Election! IT IS IMPORTANT THAT YOU REMEMBER TO VOTE! By this time, you should have received your Age Verification Form via mail. The Age Verification Form must be filled out by everyone residing in Solera Diamond Valley to certify their eligibility to reside in the Association. The form is due back to the office by Dec. 12, 2022. According to the Governing Documents of the Association, failure to submit a completed Age Verification Form could result in a fine of $100 per occurrence. Lastly, I hope that you have had a chance to meet our new Front Desk Concierge, Luke Petersen. Luke was promoted from Facility Monitor to Concierge last month and has been doing a great job adapting to his new role. If you haven't already, stop by the front desk and say hi.
