FOUR SEASONS BREEZE | DECEMBER 2018 5 AGE VERIFICATION Thank you to everyone who has already submitted their updated Age Verification form. If you have not already done so, please drop them off at The Lodge as soon as possible. Again, this is something that the Association must do every two years to keep our age qualified status and be a 55+ community. CC&R CHANGES By now you will have received a large packet of information, ballot and return envelope for the proposed CC&R changes. We have held a Town Hall and the presentation from that will be on our website, www.fourseasonsbeaumont.org. The Association is not spending $5.2 billion dollars as the country did for the recent midterm elections, however this is a considerable expense in printing and mailing such a large packet. Please vote before the scheduled tabulation date of Dec. 17. If you have any questions, please call me or visit me at The Lodge and RCN. LAWSUITS & INSURANCE We live in a very litigious society. One only has to watch TV for a few minutes during the day to be bombarded by advertisements by legal firms to see this in action. While people have a right and option to seek relief in court, being threatened with a lawsuit is no small matter. The Association's insurance policy is a "claims based" policy. That means that any time someone threatens to sue the Association I must inform the insurance carrier, otherwise if that person does sue in the future and the carrier was not put on notice they can deny coverage. In the last few months, I have put the carrier on notice because someone said they were going to sue the Association for poor landscaping in their yard. I had to inform the carrier when a resident said they were going to sue the Association because a fellow resident spoke rudely to them in The Lodge and that resident wanted the speaker banned from The Lodge immediately. The Association recently renewed the insurance policy in November, and the Director's & Officer's Liability (D&O) coverage deductible went from $10,000 to $50,000 which is a 400 percent increase. When the insurance carrier is notified, the billing starts because a folder is started and basic research begins. So every threat of a lawsuit is costly despite whether it is an idle or real threat. The keepers of the books are working on getting more storage/bookcases for our very generous community. We have many new residents who would like to donate and are frustrated by the request to hold off on donations. We currently have a proposal that, we hope, will go to the Board in December and receive overwhelming approval.
