18 FOUR SEASONS BREEZE | JULY 2020 The ARC rarely fails to approve submitted plans. In almost every instance when a disapproval is issued, the reason is that the application is either incomplete or it does not have sufficient detail to support what is requested. The goal of the ARC is to assist homeowners to make their yards and landscaping meet both their wishes and comply with Architectural Guidelines and Standards. When we receive an application that is missing required information, the committee tries to contact the homeowner for clarification. If the homeowner is in attendance at the meeting we are able to ask for the information as we discuss the application. In the event that the homeowner is not at the meeting we call the phone numbers listed on the application. For this reason we are requesting that if you do not attend the meeting when your application is discussed, please be available to take our phone call. Most of the time we are able to reach the homeowner and resolve the issue(s). However, since the committee members are volunteers and use their own personal phones to make the calls, FirstService is not displayed as the caller. The phone number of the committee member is displayed. If we are unable to reach the homeowner, we have no option other than to disapprove the application and send a letter to the homeowner explaining the issue and request that they resubmit the application. In almost every instance, if something is requested that is prohibited by the Architectural Guidelines and Standards, the committee has been able to suggest an alternative that meets both the guidelines and the homeowner's needs. A checklist of required documents is available with the application packet. If you attach each of the listed/required forms the committee will have the required documents. On occasion, the nature of the application may not be clear and will require ARC to communicate with the homeowner. All applications are required to be submitted to either The Lodge front desk or the Management office in the RCN prior to noon on the Monday prior to the ARC meeting. Meetings are held the first and third Wednesday of each month. Due to the time required to process the applications for the meeting and the requirements to publish agendas as required by the Davis-Sterling Act no late applications can be accepted. Please be advised that no committee member or FirstService Residential employee can give verbal approvals or waive any of these requirements. As specified by the Architectural Guidelines and Standards: • Each application is reviewed and evaluated by the ARC on the basis of individual merits of the proposed work and is considered in light of specific implications of location and impact on surroundings. • There are no "automatic" approvals. An application for work identical to work already approved by the ARC or that is identical to existing work anywhere in the community might or might not receive ARC approval. • The approval, conditional approval, or disapproval by the ARC of any proposed work does not bind the ARC to take the same or similar action on any other proposed work at any other time for the same or any other property owner. • An oversight of ARC Guidelines does not constitute waiver of the guidelines and must be corrected upon notice. Please be advised that work that may not appear to be compliant with these guidelines may have been completed under different guidelines that have changed (including changes in city and state laws), may be the result of a granted variance, may have been completed without authorization and/or may be in the process of being resolved and corrected by the Board of Directors. Finally, as the homeowner, you are responsible for compliance with these guidelines. Do not rely on your contractor for interpretation of the guidelines, to complete the application process, or to negotiate with ARC for variances. We do have more than one contractor working in our community who fails to complete applications and advises homeowners to complete work without approval - advising them that a variance will be granted. In those instances when ARC is asked to review work that was completed without approval, we consider the application on its merits. We do not base our decision on the costs or inconvenience of correcting or removing work that does not comply with the guidelines.
