Outstanding Projects: Vice President Deacon will assist in the completion of outstanding projects in conjunction with the assigned Board Liaison, provide coverage for Board members who cannot attend their committee meetings, and assist in preparing golf course information to be disseminated to the membership. Golf Course Issues: President Bowman will be working weekly with General Manager Morgan to discuss and continue to move forward on all golf course issues. Attorney Rian Jones will be zoomed into these discussions at times, to assist in this effort. BOARD OF DIRECTOR REPORTS: Vice President Deacon: Thanked Elizabeth Ashley and the Emergency Preparedness Committee, Don Wardell and the Rules and Regulations Committee for the opportunity to serve as their Board Liaison. For the upcoming 2020-21 term, VP Deacon will be serving on the Golf Course Committee with Pres. Bowman and Mr. Mitchum. The Committee will meet to research and present findings for Board consideration regarding the golf course. Secretary Horlock: Thanked the Communications, Violations and Golf Course Committees for the opportunity to serve as their Board Liaison. She will continue with the Social Committee and has been newly-assigned to the Architectural Control and Neighborhood Information Committees. Treasurer Sailer: The Sailers have lived in The Colony for 16 years and married for more than 61 years. He has served on the Board of Directors, several Committees, was the President of the Racquet and RV Clubs. He will serve as Board Liaison to the Finance Advisory, Landscape Advisory and Violations Committees. Director Plummer: Serving as Board Liaison to the Access Control and Safety, Emergency Preparedness, Recreation/ Fitness Advisory and the Sunshine Committees. She encouraged the membership to join the AC&SC as they are looking for new members. Director Mitchum: Thanked the membership for all their votes. He and his wife have lived in the community for 20 years and he has previously served on the Board of Directors. He will assist with the Golf Course Committee, serve as Board Liaison to the Communications, Violations and Rules and Regulations Committees. Code of Ethics: The Board is currently working to amend the Code of Ethics. Signers for Financials: The primary signers to the Association bank accounts are Treasurer Sailer and Secretary Horlock. Directors Bowman and Deacon, and Gen. Mgr. Morgan will serve as backup signers. Political Signs: Residents have reported that their political signs were being taken from their property. President Bowman strongly encouraged residents to leave their neighbor's political signs alone and respect their property. Southeast Automatic Door: By Oct. 20 the Clubhouse's southeast doors will be automated, making it easier for residents to enter the Clubhouse. Civility and Congeniality: Given the current pandemic and national election, many residents are experiencing negative feelings. President Bowman encouraged residents to live with civility and congeniality and work together to restore harmony in our community. Litigation with the owners of The Colony Golf Course has been going on since 2012. We won our case at trial and obtained a judgment against the owners mandating that they repair and maintain the golf course according to maintenance standards contained in the deeds and contracts for the purchase of the golf course. That judgment was entered in March of 2016. The owners of the golf course immediately appealed the judgment. The court of appeals denied the appeal on May 10, 2018. The owners of the golf course then petitioned the Supreme Court to hear their appeal. The Supreme Court denied their request on July 25, 2018. The case was sent back to the trial court on the next day. The judgment mandated that the owners of the golf course must take action to improve the condition of the golf course within certain time frames. The clock started on those mandates when the judgment was affirmed by the court of appeals and sent back to the trial court. The outside time frame was six months to comply with the mandates. Obviously, the owners of the golf course did not comply and, in accordance with the terms of the judgment, we retained an expert consultant to inspect the golf course and to issue a report of the deficiencies and failures to comply with the judgment which we then sent to the owners of the golf course with a demand that they comply within 30 days. That letter was sent on Feb. 21, 2019.
