8 | THE COLONY NEWS | DECEMBER 2020 | HOA NEWS BOARD OF DIRECTORS MEETING HIGHLIGHTS: OCT. 15, 2020 VIA TELECONFERENCE Directors Present: President Walt Bowman, Vice President Joanne Deacon, Secretary Amy Horlock, Treasurer Glenn Sailer, Director Del Mitchum and Director Mary Ann Plummer Absent: Director Tom Brackin Others Present: General Manager Jim Morgan, Office Mgr/ Admin. Asst. Kimberly Evans MEMBER QUESTIONS AND BOARD RESPONSES: Prior to the Oct. 1 and 15 General Board meetings, an eBlast message was sent out to the membership which allowed them to leave a Member Question for Board review and consideration. The comments were read during the Open Session meeting by President Walt Bowman and responded to accordingly. Each resident who asked a question will receive a letter with the Board's response. Oct. 1 questions Q: I would like to request that the Board of Directors revisit their decision to not allow guests to play on The Colony tennis courts. A: The Colony staff, vendors, security, and contractors are not guests. They are essential to the continued operation of our community. The Board has chosen not to permit guests to use our common area facilities to allow our residents to use the facilities with limited exposure to people who do not live or work within The Colony. Q: When will the electrical issue in the auditorium be repaired? A: The electrical panel meets Code requirements and is not a hazard. The house light system is being retrofitted because the switch is not operable. This is also not a safety hazard. Options for the retrofit are being investigated because the existing system is no longer being manufactured. Q: Can the spas be reopened? A: The State Health Department has specifically stated that spas are not to be opened. Q: What is the procedure to stop racist harassment in The Colony public areas? A: The Colony does not endorse or support any form of discrimination. If you witness any discriminatory behavior in the common area or see a statement in an Association publication, please notify the Association staff so that the behavior or statements can be properly addressed. Q: Recently, some residents have experienced the locks on the cluster mailboxes as inoperable. Is there something in our CC&Rs about cluster mailbox responsibilities? A: No, there is no mention of the responsibilities in the CC&R's. The Board will consider adding a specific reference to the governing documents. Historically, The Colony cares for the boxes and the owners care for the locks on their boxes. Oct. 15 questions Q: It would be beneficial to the Community if the Executive Session Updates indicated the subject matter(s)! Will the Board consider providing more information in these updates? A: The Board will review its procedures and determine whether more detail can be given without revealing confidential information. Sometimes merely stating the topic can reveal confidential information, but there may be instances where more information can be provided. Q: After viewing the past several meetings, I am of the impression that the meetings appeared to be orchestrated and were presented only as a formality. Will this new board turn this impression around? A: The Board does not meet to make decisions prior to the Board meetings. The Board members do receive the Board packet in advance and every Board member is expected to review the packet and be prepared for the Board meeting. There have certainly been times when the Board decisions were not unanimous. Q: What has the Board done to protect our community and change the CC&Rs to address all of the new laws that are taking effect Jan. 1, 2021, such as ADU and unrestricted rentals? A: The Board is in the process of developing rules to address ADUs. The creation of ADUs is now largely regulated by state, county and city law so any regulations adopted by The Colony will be limited to compliance with those regulations. The Board is also in the process of reviewing The Colony governing documents for any changes needed to comply with the recently enacted state law changes to renting and leasing of homes effective Jan. 1, 2021. Q: Can the speed indicator sign located on Colony Drive near Via Ambiente be moved to between Corte Albara and Corte Carrio? A: The Board already plans to relocate the referenced speed indicator sign. Q: Why is Walt Bowman continuing as the President of the HOA? Del Mitchum had over 100 more votes than Walt. A: The Board has complete discretion to choose its officers. Officer positions are not based on the number of votes received in the membership election.
