| THE COLONY NEWS | JANUARY 2021 | 9 HOA NEWS On Dec. 9, 2020, there was a Trial Setting Conference held in Riverside Superior Court for the Association's lawsuit against Majestic Asset Management LLC. This lawsuit seeks to set aside a fraudulent trust deed imposed on the golf course property for approximately $3.4 million. Because of the current COVID-19 pandemic, the earliest trial date that the court would set was Oct. 1, 2021. The court also ordered the parties to mediate this dispute within 90 days from January 1, 2021. A mandatory settlement conference is also scheduled for Sept. 22, 2021. The case is presently in the discovery phase and we expect that depositions of parties and witnesses will begin in late February or early March of 2021. In the ongoing case against Majestic, Wintech and Jen and Hai Huang regarding the failure to maintain and operate the golf course, the court-appointed receiver is still in place and working hard to improve the condition of the golf course and increase the income of the golf course to provide funds to comply with the judgment mandating that the golf course be repaired and maintained to the standards in the permanent injunction issued by the court. There is a status conference scheduled for Jan. 20, 2021, in this case, where the court wants to hear an update from the receiver on his progress towards complying with the judgment and permanent injunction. At its Jan. 21, 2021 Open Session, the Board intends to present a more in-depth report as it pertains to the ongoing golf course litigation. ~ Board Golf Course Committee By Rita Nastri, 698-8640 Cookies! Thank you all so much for your quick response to the Call to Action for cookies in December for our beloved Marines at Camp Pendleton! Thank you to Carol Swanke for putting my request quickly on Colony emailers and to Sharon Boll and Kara Hardy, and to Ann Carter, who in lieu of her usual Christmas cookie exchange (you can guess what happened to that this year) put a request to our 9 am exercise class to instead bake cookies for the Marines. I received calls and personal emails that first day and a quick delivery of two boxes of bakeshop cookies the next, and I continued to receive dozens more until I delivered all of them on Dec. 9 — a total of 150 dozen! That's 1,800 cookies! What a great group you are! It's no wonder the Marines admire Colony residents so much! Thank you to everyone who baked and sent cookies for our Marines.
