10 | SUN LAKES LIFESTYLES | APRIL 2021 | The Board reviewed the following proposed amendment, to the Sun Lakes Country Club Homeowners Association General Statement of Rules and Regulations (revised Dec. 19, 2019 edition), that appears on the Association's website (sunlakescc.com) and are available in the administration office (please reference ARTICLE IV – General Rules), at its Feb. 24, 2021 Open Session meeting. The Board will vote upon the proposed amendment at its May 26, 2021 Open Session meeting, following publication in the April 2021 edition of Lifestyles. If the Board votes in favor of the proposed rule change it would go into effect June 1, 2021. Purpose: The purpose of the proposed rule change is to make members aware that when they do business with the Association's golf, food and beverage, and other Association amenity operations, the members will be using the Association's point-of-sale ("POS") system provided by an independent company known as Clubessential. Use of the POS system means that end-user data about the Association's members, residents or any other customers is entered into the Clubessential system, including, but not limited to, the end-user's name, billing address, credit card number, expiration date, and CVV code. Depending on the transaction, other personal information of the end user, like bank account and routing numbers, may be collected as well. Internet protocol ("IP") addresses, browser information, social media, and geographic data may also be collected by the POS system depending on the transaction. The foregoing are merely examples of end-user data collected by the POS system. Other information will also be gathered. For a fuller understanding of the nature of the POS system and the data collected, please go to https//www.clubessential.com and click on both the Terms of Service and the Privacy Policy. Please note that the Terms of Service and Privacy Policy may be revised by Clubessential from time to time. Because the POS is effectively the Association's cash-register system, all members, residents and any other customers who do business with the Association's golf operations, food and beverage operations, and other amenities that collect any payments will share their personal data to varying degrees through the POS system. Effect: The effect of the rule change is that any members, residents or other persons who may refuse to utilize the Association's POS system will be unable to access or use the Association's golf operations, food and beverage operations, or other Association amenities that rely upon the POS system. Proposed Rule Change Article IV – General Rules – 4.10 Mandatory Point-of-Sale System. Use of the Association's golf operations, food and beverage operations, and other amenities which utilize the Association's POS system requires that customer (end user) data be entered into that system. All persons using the Association's golf operations, food and beverage operations, and other amenities consent to the collection and use of their end-user data in the POS system in accordance with the Clubessential's Terms of Service and Privacy Policy, the terms and conditions of which may change from time to time (https//www.clubessential.com). The Association makes no warranties or representations regarding the security or confidentiality of the end-user data collected. Membership Comments: Members who wish to comment on the proposed rule change may submit their comments, in writing, via email, to the Association Executive General Manager who will provide those comments to the Board of Directors. Members may also attend the open Board meeting scheduled for March 24 when the Board is scheduled to consider this rule change and offer comments to the Board at that open meeting.
