| SUN LAKES LIFESTYLES | AUGUST 2021 | 5 While the Common Interest Development Industry lobbied against Assembly Bill 3182, the California legislature has passed this new rental restriction legislation and Governor Newsom signed the bill into law. The intent of AB3182 was to "bring many more rental units to the state at virtually no cost" in an attempt to address California's housing crisis. Unfortunately, not only does this new law do little to address California's housing crisis, it also severely limits an Association's ability to protect the value and integrity of their community by adopting common sense rental restrictions. The good news is that this law does still allow Associations to adopt and/or enforce governing document provisions prohibiting transient occupancy or short-term rentals for 30 days or less. The bad news is the new law prohibits Associations from adopting or enforcing the vast majority of common rental restrictions and significantly increases an Association's liability related to rental restrictions governance. Since we had a provision that did not allow rentals for less than a year, now we must change our rule to comply with the state law. The new law also prohibits the Association from adopting or enforcing governing documents provisions requiring a mandatory waiting period before a new owner may rent their unit. Obviously, we have no control of when the state of California enacts a new law. We must conform or be held accountable. Along with the situation is the process of changing our governing documents to conform to the new law. There is no choice. Since our CC&Rs stipulated that our members must authorize the change, it was placed on the ballot last April to approve the change. This was a legal formality needed for our Board of Directors to start the process of changing our documents. Unfortunately many of our members voted "NO" and the provision did not pass. The change had to be made or the Association would have been guilty of not obeying the law and probably heavily fined until the change was made. The alternative was the Board of Directors to seek a court order setting aside the membership vote and the court allowing the Board to make the changes demanded by the legislature. The result of the vote in April and the necessity of going to court caused a large, unnecessary expense and a delay of the changes to our governing documents. If this or a similar situation happens again, please adhere to the request of the Board of Directors or at least seek information that would clarify what they are requesting. HOAs statewide are lobbying to have Associations excluded from this and other bills involving housing situations. We hope they are successful. DISTRICT DELEGATE ASSEMBLY REPORT CA LAW AFFECTS HOA RENTAL RESTRICTIONS By Joe Formino, Chairman, District Delegate Assembly Congratulations to Linda Vang on her promotion to Lifestyle Coordinator. We all know Linda from her friendly greetings at the reception desk of the Main Clubhouse, but as of the end of May, Linda is serving our community in her new position in the Recreation Department. Linda's primary responsibility is to maintain the master calendar for all Sun Lakes activities, handle room reservations, and oversee scheduling needs. This includes the Sun Lakes Master Board, Delegates, Advisory Committees, Clubs and private party requests. Available meeting places are limited, and it's Linda's job to try to accommodate all of these groups according to the governing rules. This is quite a task as we can imagine. In addition, Linda will assist in Recreation Department events. Linda began working at Sun Lakes six years ago as part of the Restaurant staff. She was promoted to the reception desk after four years, where she has worked for a little under two years. Linda is excited about her new position and happy to be part of our Sun Lakes family. We are pleased to have Linda as part of the Recreation Department staff of FirstService Residential and look forward to supporting her in her new position. We also welcome Conzuella Terrell, Linda's replacement as receptionist in the Main Clubhouse.
