• Dumpster Rule – Approved Giveaway and Free Items Rule – Management presented the following Giveaway and Free Items rule for final approval, and it was published for 30-day member comment. Tabled due to numerous member comments opposing the rule. 5.11 Giveaway Items. Residents who wish to place items on the driveway for giveaway may do so only on Saturdays between 8 am and 12 pm. Such items are limited to five and may not extend over the gutter area. If the items are not removed by 12 pm, the resident is subject to a possible citation. The exceptions are prearranged charitable donations or a special request pickup. These exceptions may be placed outside the residence only on the scheduled day of pickup. Proposed Rule Change Architectural Control Committee Rule Change – Approved for 30-day member comment. See below. These rule changes, approved by the Board of Directors at their Regular Session meeting on Oct. 21, 2021, are now in effect: ARTICLE 4, VEHICLE AND ACCESS RULES 4.1.16 A vehicle must be parked between the lines of the Clubhouse parking lot. Any tire that is parked on or over a line may receive a warning as a first offense. AGE VERIFICATION RULE If a homeowner does not comply with the Age Verification Rule within the allotted time given, a written notice will be issued indicating a $25 fine will be assessed 30 days after the allotted time, an additional fine of $50 will be assessed 60 days after the allotted time and a $50 fine plus a possible 30-day suspension of privileges will be assessed 90 days after the allotted time. HOME INSPECTION VIOLATIONS RULE Upon receipt of a letter from Property Services Department for a non-compliance of any architectural requirement, the homeowner has 30 days in which to correct the non-compliance or file an appeal. If, after 30 days, an appeal was denied or not filed and the non-compliance not corrected, a $25 fine will be assessed. If the non-compliance has not been corrected after 60 days, a $50 fine will be assessed and after 90 days, a $50 fine will be assessed plus the possible suspension of privileges for 30 days. 5.20.2 DUMPSTERS Before arranging for a delivery of a bulk trash receptacle, normally called a dumpster, a resident must notify the HOA Office of the address where the dumpster will be located and the expected date of delivery. Dumpsters may not be in place for more than 3 days. Residents may ask the HOA for an extension. Dumpsters, when placed on the driveway, may not extend beyond the curb line, may not be set on the grass and may not interfere with front yard landscaping. If a Dumpster is on wheels, the wheels must be locked or chocked in a manner that prevents it from rolling. Dumpsters may not be placed in the street without obtaining permission from the HOA Office and must have reflectors attached on both ends or have traffic cones placed at each corner. Traffic cones must be a minimum of 28 inches tall and equipped with reflective collars. In accordance with Civil Code #4360, Rule Making Procedures, this proposed rule revision is presented for member review. Please provide, in writing, any comments or questions you may have regarding this revision to the Board of Directors within 30 days of this receipt. At the Board of Directors Regular Session on Oct. 21, 2021, the Board recommended the following rule revision for 30-day member comment, to be voted on at the Regular Session in January, 2022: 14.3 ARCHITECTURAL COMMITTEE 14.4 The ACC will review and act upon the application within 30 - 40 days, depending on when the application is submitted in relation to the time of the ACC's next meeting. The cutoff date for submitting forms for review by the ACC is 4 pm the Thursday before the next regularly scheduled meeting. The time period runs only when a complete application has been submitted. In some cases, the ACC may ask for additional information. In those cases that do not meet the Architectural Standards, or the criteria of the CC&Rs, the ACC will disapprove the application.
