As we go through the next four months, members will have the opportunity to elect two Board Members to our Board of Directors. As we begin this process, it may be helpful for all of us to remember why we chose to live in a Homeowners Association and why we have a Board of Directors that governs our Association. Solera Oak Valley Greens is the official name of our Association and was established by Pulte in our Articles of Incorporation. Essential goals of our Board of Directors are to: 1. Preserve the nature and character of the community 2. Provide services and amenities to residents 3. Protect property values 4. Meet the established expectations of owners Many of the services that our Association provides were once the responsibility of our local city government. In 1978, the rules regarding how property taxes were calculated changed and local governments were faced with less money coming in. Soon, local governments began to encourage developers to form Common Interest Developments or HOAs to cover costs that were previously covered by the city. The most common characteristics of HOAs are: 1. Homeowners automatically become a member of the Association and must abide by Associations CC&Rs and Community Rules. 2. Homeowners pay a monthly assessment that is used to maintain the common areas or provide services to the Association. 3. Homeowners share ownership of common land and amenities such as our swimming pools, sports courts, Fitness Center and Clubhouse. Governing Documents: The Board of Directors must follow the legal documents that established our Association and all the City, State and Federal Laws. The documents listed below govern how the Association is operated and provide the rules for using the Association property. These governing documents are available on the Solera website and include: 1. Covenants, Conditions and Restrictions (CC&Rs): The CC&Rs detail each owner's property rights, the restriction on use of the property, and the owner's rights and responsibilities in the Association. 2. Articles of Incorporation: The Articles of Incorporation establish the Association as a Corporation and describe its purpose, structure, and powers. 3. Bylaws: Our Bylaws establish rules for the operation of the Association such as meeting requirements, election procedures and duties of the Board of Directors and Committees. 4. Community Rules: For a group of people to share property peacefully and profitably, they must agree to a common set of rules. Establishing and enforcing these rules preserve both the value of the property and the quality of life in our community. They are designed to make sharing property convenient and fair for all. This is a very brief description of what is involved in living in Solera Oak Valley Greens. In March, I will explain additional information regarding our budget, management, and enforcement of our policies and procedures. We have a 'Welcome to Solera' event twice a year and there is a presentation regarding all that is involved in living in an HOA. Everyone is welcome to attend.
