16 | THE COLONY NEWS | MARCH 2022 | HOA NEWS At the Board of Directors Regular Session on Jan. 20, 2022, the Board recommended the following rule revisions for 30- day member comment, to be voted on at the Regular Session in April 2022. The affected rules are printed below. All new information is in bold and underlined. 22. MISCELLANEOUS ARCHITECTURAL GUIDELINES 22.1.2 Free standing or pole mounted items, including, but not limited to, birdhouses, windmills, weather vanes, and spinners are allowed. However, only a maximum of 3 such items may exceed the height of a fence or wall when it can be seen from the street or common areas. Also, a personalized street name sign mounted on a pole with either a first or last name (i.e. "Rosalie Rd.," "Anderson Lane", etc.) are allowed as long as they cannot be seen from the street or common areas. Also, signs that have designs, pictures, or wording, in reference to, or similar to, road signs (i.e., speed limit, stop, yield, slow, lane ends, etc.) are not allowed. 22.1.3 Outdoor umbrellas are allowed, but not more than 1 shall be placed in the front courtyard of a non-zero lot line residence and not more than 3 shall be placed in the front courtyard of a zero lot line residence. Also, not more than 3 shall be placed in the rear yard of either a zero or non-zero lot line residence. 22.1.6 Solar lights, solar sticks and all other outdoor lights cannot be placed or installed directly on or in pots, on front fence walls, side fence walls, wrought iron fences, gates, pilasters, columns, or driveways. 23. DRIVEWAYS, FRONT WALKWAYS AND SIDE WALKWAYS RULES The Board of Directors is encouraging homeowners to maintain the value of their homes and to continue the pride of ownership throughout our community. In response to inquiries to the ACC from homeowners about making changes to driveways, front walkways and side walkways, using material other than the standard concrete installed by the builders of the homes (see list below), the following rules and procedures will apply: 23.1.1 Home Improvement Application. A home improvement application must be completed and submitted to the Architectural Control Committee (ACC). The application will be reviewed and, if necessary, a site visit to the home will be scheduled before the application will be approved. 23.1.2 The application shall include the following: (a) The type of material to be used. (b) The color of all materials to be used. (c) The pattern and design to be used (if applicable). (d) A color photograph of the home showing the area(s) to be changed, the color scheme of the home, and a diagram/ sketch showing where the product(s) is to be installed. (e) A copy of the manufacturer's pamphlet or advertisement showing the material to be used. 23.1.3 The following materials may be used by the applicant: (a) The current color and style of the existing concrete. (b) Stamped concrete pattern without color added. (c) Small exposed aggregate concrete. (d) Manufactured pavers, or other similar paver material. (e) Such other material that may be approved by the ACC. (f ) An approved combination of the above. (g) If any sealants are used on the driveway or walkway material, it must be clear and a matte finish only. 23.1.4 Other requirements: (a) All driveway and walkway replacements must conform to the existing grade for proper drainage. (b) The driveway and walkway areas referred to in this Article are the driveways and walkways in the front common areas, outside of the entrance gateway wall and posts and include the two walkways leading from the driveway to both the front entrance gate and the side yard gate (if applicable). (c) The same footprint of both the existing driveway and walkways must be used. (d) No personalized designs such as emblems, initials, monograms, crests, etc. are allowed. (e) No loose material is allowed. (f ) If sand mortar is used, a polymeric additive (or equivalent) must also be used to prevent any erosion. (g) No grass may be used on either the driveway or walkways. 23.1.5 After the ACC has received the application it will be scheduled on the regular agenda along with all other applications. The committee will review the application and schedule a site visit to the applicant's home, if necessary, to review the color and type of material, where it is being proposed for installation, pattern and design and how the material will blend and coordinate with the exterior color and model of the home, roof tiles and the color and pattern of any existing driveway or walkways to remain. It is the intent of the ACC that the changes to driveways and walkways must be used as a complementary accent to the exterior of the home. 23.1.6 Not all exteriors and configurations of the homes in The Colony lend themselves to the application of all of the materials described above in a way that will be Recommended Rule Revisions
