The residence gate may be painted the color of the stucco, the trim, the accent, black, or a white from the White Option page. 17.5 Painting the Exterior of a Home the "Same as Existing" Color. Repainting the exterior of a home the "Same as Existing" color, or colors from a previously approved color book, is not allowed. The current edition of the Colony Paint Book schemes must be used. ARTICLE 8 - FINES AND PENALTIES This Schedule is established pursuant to Article 8, Section 8.5, of the Declaration of Covenants, Conditions and Restrictions for The Colony at California Oaks (CC&Rs). In accordance with Civil Code section 5850 and the Homeowners Association's governing documents, the Board hereby approves and ratifies the following fee schedule for violations of the Homeowners Association's Governing Documents including Rules & Regulations and CC&Rs. This schedule applies to Owners, tenants and lessees. Owners shall include a provision in their rental or lease agreements requiring their tenants and lessees to abide by the Homeowners Association's Governing Documents and to be responsible for the payment of any fines imposed pursuant to this schedule. In accordance with the schedule below and the Homeowners Association's Governing Documents, the Homeowners Association may levy fines (referred to as "Compliance Assessments"). These fines shall constitute personal obligations of the Owners who are fined, and shall be billed in the same manner as the monthly assessment. Copies of the Governing Documents are available at The Colony Homeowners Association's office, and can be mailed to Owners upon request. Any suspension of privileges may include deactivating a vehicle transponder. Failure to comply with any Rules and Regulations or CC&Rs not specifically listed below. Immediate ejection from common areas; $100 fine and/or suspension of privileges for six (6) months. $75 fine, immediate ejection from common area and 30- day suspension of community privileges.
