Appreciation of Former Board Members – Walt Bowman, Amy Horlock and Glenn Sailer: President Dalfonso individually acknowledged former Board Members Walt Bowman, Amy Horlock and Glenn Sailer for their hard work and dedication while serving on the Board. Resignation of Treasurer Jim Nash: With regret and sadness, President Dalfonso announced the resignation of Director Jim Nash due to health concerns. Mr. Nash served as the Board Treasurer for the last two years and as a Director since 2018. His service to the community, humble spirit and leadership will greatly be missed. Golf Course Update, Litigation Attorney Rian Jones: Litigation Attorney Rian Jones provided a brief update regarding recent court proceedings for the two pending lawsuits. The court ruled to foreclose on the golf course during the Oct. 14 hearing. The hearing was further continued to Friday, Dec. 2 to resolve matters regarding the Association's Performance Deed of Trust. The Fraudulent Conveyance Trial Call will be held on Oct. 28 and the hearing may start on Oct. 31 if the judge is available. Financial Component to the Golf Course: Newly appointed Board Treasurer Chuck Gordon updated the Membership on the financial components of the golf course and the likelihood that the Association will continue to subsidize the golf course, as needed, in order to keep the golf course open. Architectural Appeal, Extension of Driveway: Homeowner James L. Burrow appealed the denial by the Architectural Control Committee of his application to widen his driveway by 24-inches. The Architectural Standards Article 23, Section 23.4.3 state, "The same footprint of both existing driveways and walkways must be used." Tabled and referred to Legal Counsel for further review. Tennis Backboard Practice Rule Revision – Final Approval: Management presented the 3.4 Tennis Backboard Practice Rule for final approval. Approved. Notice will be mailed to the membership. Resignation of Bo Hansson, Landscape Advisory Committee: Accepted resignation of Bo Hansson from the Landscape Advisory Committee. Resignation of Phillip Lakin, Rules and Regulations Committee: Accepted resignation of Phillip Lakin from the Rules and Regulations Committee. Resignation of Mia Jensen, Linda Hopkins and Connie O'Brien, Communications and Technology Committee: Accepted resignation of Mia Jensen, Linda Hopkins and Connie O'Brien from the Communications and Technology Committee. Emergency Agenda Item - Turf Overseeding: Due to water reductions, the current water cost is $76,813 (YTD) under budget. Staff is recommending that $45,000 be used for re-seeding the bare spots in front yard and green belt turf areas. Approved using GL-6155 Sod/Seed Replacement at a cost not to exceed $45,000. Annual Tree Inspection/Tree Replacement: Management completed their Annual Tree Inspection with the Landscape Advisory Committee and Environmental Concepts Landscape Maintenance Arborist. During the walkthroughs, all trees are inspected and a determination is made if they need to be removed or replaced. Approved ECLM proposal to replace various trees at a cost of $5,805. Heat Damage Plant Replacement: Management completed their inspection of plants that were damaged due to heat. The 2022 heat caused more stress than usual with many plants needing to be removed and replaced. Approved ECLM proposals to remove and replace various heat-damaged plants in the community at a cost not to exceed $8,305.50. Revision to Article 14.7.4 Antennas: Architectural Control Committee submitted revisions to Article 14.7.4 Antennas for Board consideration. Tabled for further review. Revision to Article 15.4 Fences, 30-Day Member Comment: The Architectural Control Committee revised Rules 15.4.1 and 15.4.2 regarding the wrought iron fencing and mesh barriers. Approved the rule changes for 30-Day Member Comment. Members can reference the proposed rule revisions on pages 10-13 of The Colony News. Revision to Article 17 Painting Procedures, 30-Day Member Comment: The Architectural Control Committee is proposing to revise Article 17 Painting Procedures of the rules and regulations so that homeowners will no longer be able to use "same as existing" or paint colors of previously-approved Colony Paint Books when repainting their homes. Homeowners will be required to use the approved Paint Book Colors. Approved the rule changes for 30- Day Member Comment. Members can reference the proposed rule revisions on pages 10-13 of The Colony News. Revisions to Article 8 – Fine and Penalties Schedule, 30-Day Member Comment: The Violations Committee has made deletions and amendments to Article 8 – Fines and Penalties rules, which address subsequent offenses and other needed changes. Approved the rule changes for 30-Day Member Comment. Members can reference the proposed rule revisions on pages 10-13 of The Colony News. Project Approval to Research 5G Home Internet Service: The Communications and Technology Committee submitted a request to research 5G Home Internet Service. Tabled for further discussion. Approval of Service Terms for Christmas and New Year's Social Events: The Social Committee will be hosting a Christmas Ball on Saturday, Dec. 10 and New Year's Eve Party on Saturday, Dec. 31, which will include a buffet dinner and entertainment.
