8 | THE COLONY NEWS | APRIL 2023 | The following proposed Rules and Regulations were approved by the Board of Directors at the Feb. 16 General Board meeting for 30-day member comment: 15.6 GAZEBOS, ARBORS AND PERGOLAS. Gazebos and Pergolas are defined as freestanding roofed structures, without any walls, solid or transparent, typically round, octagonal, square or rectangular, that offers an open view of the surrounding area. The roofs can be either open slats or solid. Gazebos and Pergolas can only be made out of wood, vinyl or metal. No fabric or canvas or similar material is allowed. 15.6.1 Gazebos and Pergolas are only allowed to be installed in the backyard. There can only be either one (1) gazebo or one (1) Pergola per lot and it cannot exceed twelve (12) feet in height. 15.6.2 The roof of a Gazebo or Pergola can be solid or have an open spaced framework. The color of the Gazebo or Pergola must be only one color. No two-tone colors are allowed. The color must be compatible with the paint scheme of the home. 15.6.3 Arbors are defined as an archway with a roof formed by trained climbing plants over a framework that can only be made out of wood, vinyl or metal. No fabric or canvas or similar material is allowed. 15.6.4 Arbors are allowed to be installed anywhere on the lot. There can only be two (2) arbors per lot and the arbor cannot exceed eight (8) feet in height. All arbors must be installed behind the front yard or side yard entry gate. Arbors cannot be installed outside the gates on the front yard property. 15.6.5 The color of the Arbor must be only one color. No two- tone colors are allowed. The color must be color compatible with the paint scheme of the home. 15.6.6 No Decorative Accessory can be affixed to, hung from, or in any other manner attached to a Gazebo, Pergola or Arbor. 15.6.7 Home Improvement Application. A Home Improvement Application must be completed and submitted to the Architectural Control Committee (ACC) before installation of a Gazebo, Pergola, or Arbor. The application shall include the following: (a) A color photograph of a sample of the Gazebo, Arbor or Pergola that includes all dimensions (height, width and length). (b) The color of and the material used. (c) A color photograph of the residence that has a diagram/ sketch drawn on the photograph showing exactly where the Gazebo, Arbor or Pergola is to be installed. 15.6.8 After the ACC has received the application, it will be scheduled on the regular agenda along with all other applications. The ACC will review the application and schedule a site visit to the applicant's residence (if deemed necessary) to review the color of the residence, the location where it is being proposed for installation and how it will blend and coordinate with the exterior color and architecture of the home. 15.6.9 Each application will be evaluated individually, and a decision will be made on a case-by-case basis. A Gazebo, Arbor or Pergola that may be approved for one residence may not be approved for another residence, due to the lot size of the residence or the size of the area where the Gazebo, Arbor or Pergola is proposed for installation. The square footage of the proposed Gazebo, Arbor or Pergola will be carefully evaluated to achieve a reasonable balance in the yard area. In accordance with Civil Code #4360, Rule Making Procedures, these proposed rule revisions are presented for member review. Please provide, in writing, any comments or questions you may have regarding these revisions to the Board of Directors within 30 days of this receipt. PROPOSED RULES REVISIONS
