4 | THE COLONY NEWS | MAY 2023 | Board meetings are for the purpose of conducting Board business. Civil Code section 4925 states that homeowners are allowed to attend Board meetings except when the Board adjourns to executive session. In open session Board meetings, the law requires the Board to permit association members to speak and allows the Board to set reasonable time periods for all members to speak. The law does not require Board members to respond to homeowner comments in open session. Typically, questions which require a response would be addressed directly with the individual member at a later time by management on behalf of the Board. The Board generally cannot act on issues or concerns raised by owners during a meeting. Civil Code section 4930 only allows the Board to consider and act upon agenda items at a meeting with only limited exceptions for emergencies or the need for immediate action. Civil Code section 5900 requires that Board meetings be conducted using some form of parliamentary procedure. This procedure is intended to address the process of considering and acting upon Board business but does not supersede or control over the requirements of the law and the association's governing documents. The purpose of using parliamentary procedure is to allow business to be conducted in an orderly manner. While the Board appreciates input from all members, the Board is ultimately responsible for governing the business activities of The Colony with the assistance of management. The Board consistently seeks expert advice when needed and is very aware of its duty to act in the best interests of The Colony. The Board appreciates the support received from community members and encourages members with an interest in taking a greater role in The Colony to consider serving on one of the many committees who support The Colony on a daily basis. BOARD MEETING CONDUCT BOARD OF DIRECTORS MEETING HIGHLIGHTS: MARCH 14, 2023 Highlights are a condensed and preliminary dra until approved by the Board at the next meeting. A complete copy is available in the HOA office. General Board Meeting Purpose: Meetings are to conduct Board business. Resident interruptions are not allowed; comments allowed at designated time. Only a Board member can call a point of order. Members welcome to attend meetings, send emails, letters and comments. Golf Course Update: Fraudulent Conveyance trial call scheduled for March 17. Value of Performance Deed of Trust hearing will follow. Small Claims Hearing: Association prevailed in case filed by homeowner. Age Verification, April 24 – May 5, 2023: Every owner or person residing here must biennially complete a form to certify their eligibility to reside in The Colony, a senior community. Resident must complete their own form. Resident vehicle decals will be updated. Age Verification package to be mailed in early April, with schedule of streets and dates to register. 2023-2024 Budget Mailing: Increased assessments from $270 to $320 per month effective May 1, 2023. Payment coupon booklet to be mailed. Members with auto withdrawal need take no action. Members with bill pay through their own bank should change payment amount. January 2023 Treasurer's Report: Approved. Total Operating and Reserve Liabilities and Equity are $5,481,000. March 2023 Subsidizing of Golf Course: Approved amount of $25,766. Turf Renovation Project, Landscape Advisory Committee: Approved proceeding with Rancho Water District Turf Renovation project. Community Yard Sale Guidelines: Upheld current guidelines. Public not allowed, only invited guests. Pool Concrete vs. Pavers: Approved replacing with concrete. IT Managed Services: Approved C3 Tech proposal for IT Managed Services for three-year term beginning May 1, 2023. Annual cost: $16,172. Charter/Member Quantity Amendment, CATCOM: Approved increase from 14 to 17 members. Primary Board Meeting Camera Replacement, CATCOM: Request to replace 2 Canon XLH1 cameras, purchase Blackmagic Design Video Assist, camera case and tripod. Board preferred to replace cameras with Auditorium audio/visual upgrade later this year. Approved Blackmagic Design Video Assist, camera case and tripod: cost $1,100. Proposals for Engineering Plans, Bidding Documents and Project Management 2023 Asphalt Rehabilitation Work, Associated Engineering Consultants: Approved: total cost $25,790. Replacement of West Spa Sand Filter: December failure of spa's sand filter/backwash valve forced spa closure. Ratified action taken: total cost of $4,150. Santiago's Beauty Salon Contract: Approved renewal: monthly rent of $850 through April 30, 2024. Amendment to 17.2.2 (f ) Stucco Paint Color, 30- Day Member Comment: Architectural Control Committee recommends amending Article 17 Painting Procedures, 17.2 Color Scheme Selection, 17.2.2 (f ). Current rule states that stucco can be painted with satin paint. Reputable painters say using satin paint on stucco highlights all irregularities and looks very shiny in contrast to surrounding homes. Approved publishing for 30-Day Member Comment. Final ruling to be made at the June meeting. 2023-2024 Association Insurance Renewal: Approved renewal with LaBarre/Oksnee. Cost not to exceed $89,707.
