10 | THE COLONY NEWS | JUNE 2023 | ARTICLE 2 - POOL AND SPA RULES 2.1 Hours. 6 am to 10 pm Lap Swimming: 6 am to 9 am Water Aerobics: 9:45 am to 11 am General Swimming: 11 am to 10 pm 2.1.1 Use of the pool and spa is restricted to residents and their guests. Residents must accompany their guests at all times. 2.1.2 Hours for guests under eighteen (18) years of age are as follows: Daily, Monday through Friday: 11 am to 2 pm Saturdays and Sundays, Memorial Day through Labor Day: 11 am to 3 pm Before and after the above hours, guests under eighteen (18) years of age are not allowed in the fenced enclosed pool area. 2.1.3 Regular and non-swim diapers, or their equivalent, are not allowed in the pool and spas. Children who are not toilet trained are not allowed in the pool and spas. Adults with urinary incontinence are allowed in the pool and spas with a swim diaper. Persons with diarrhea and bowel incontinence are not allowed in the pool and spas. 2.1.4 Use of the spa is restricted to persons eighteen (18) years of age and older. No more than a fifteen (15) minute time period is recommended. 2.1.5 Residents shall not lend or give the pool key to any non-resident. Any non-resident with a key will have the key confiscated. 2.1.6 Lifesaving equipment shall be used for emergencies only. 2.1.7 Pool lifts are for the use of residents and guests who require assistance when entering or exiting the pool and spa. Instructions for use of the pool lifts are available in the HOA Office. If lifts are covered, please contact maintenance personnel and they will remove the covers. Staff is NOT permitted to assist residents on pool or spa lifts. 2.1.8 Proper swimsuit attire shall be worn in the pool area. No wet-suits or cut- off jeans are permitted in the pool. 2.1.9 Persons in swimsuits are not allowed in the Clubhouse except to use the rest rooms. Entry to the restroom is limited to the east rear doors opposite the shuffleboard courts. 2.1.10 Toys, such as surfboards, Frisbees, and footballs are prohibited. Residents are permitted to use items for safety or health improvement, including flotation devices such as noodles, arm floaties or fastened floatation belts, provided they do not interfere with scheduled pool activities. These same rules apply to all guests of members during the posted hours for guests under eighteen (18) years of age. Classes given in the pool may use equipment at the discretion of the instructor. 2.1.11 Food and drinks are prohibited within five (5) feet of the pool and spa areas. Glass containers are prohibited in the entire pool area. 2.1.12 Smoking is prohibited within the fenced and gated pool and spa areas. ADOPTED DATE: 08/18/2022 2.1.13 Running, rough play in or out of the pool, and excessive splashing are prohibited. No diving, jumping or body tossing into the pool is allowed. 2.1.14 Lifeguards are not provided in the pool area. Residents and guests use the pool area at their own risk. Neither The Colony Homeowners Association nor the Management Company shall be liable for any injury occurring in the pool area or for any items lost or stolen. 2.1.15 Residents must close the gates when entering or leaving the pool area (Health Department ruling). 2.1.16 Pets are not allowed in the pool area unless they are service dogs. 2.1.17 Residents and guests are REQUIRED to shower prior to entering the pool and/or spas. POOL & spa RULES POOL & spa RULES Unfortunately, we must repeat our friendly reminder in the June edition. The Colony CC&Rs set forth restrictions associated with "Pets and Maintenance of Animals within the Community" (Article 10, Section 10.18, pg. 48-49). These restrictions apply to all owners. All landlords are responsible for communicating these restrictions to tenants with pets who rent property within The Colony. We especially want to point out: • You must pick up aer your dog! • Dogs are to be kept on a leash at all times when being walked. Note: The golf course is not HOA property; it is privately- owned. Therefore, for Colony residents: • No walking your dog on the golf course at any time. • No letting your dog "off leash" on the golf course at any time. Non-compliance will result in Violations being issued to homeowners. Animal control violations may result in fines; possible removal of pet; and possible suspension of community privileges.
