Golf Course Litigation Update: Judge ordered legal counsel for both parties to submit their closing arguments in writing regarding the Golf Course Foreclosure Hearing by April 10. President Dalfonso believes the Association argued their case successfully, especially during cross examination. Judge will make her ruling before the Fraudulent Conveyance Hearing scheduled for May 12, 2023. What's New at the Golf Course: President Dalfonso gave a brief update on the golf course operations as reported by Trigild, the court-appointed receiver. Despite the heavy rains in February, the golf course revenue has shown improvement compared to prior months. The improvement in revenue is primarily due to a slight increase in the rounds played, as well as an overall increase in the cost per round. Things are trending in the right direction. The fairways and greens are in good shape. A lot of work is being done in the roughs. The golf course has only three maintenance people, but they are doing as much as they can to maintain it. A few Colony residents also meet every Tuesday to help clean up the course. Weeds on the slopes are growing quickly because of the rain. We are concerned that if the HOA pays to trim them down now, we will have to do it again later. The golf course is asking for patience in this regard. Budget Mailing: Homeowners should have received their 2023- 2024 coupon booklet with the new assessment payment. Members who pay via automatic withdrawal need not take any action. Members who set up payment through their bank should change their payment amount to $320 effective May 1, 2023. Age Verification: Residents should have received their packet. Age verification will be April 24, 2023 – May 5, 2023 from 8:30 am to 12 noon, Monday-Friday. Resident vehicle decals will be updated. Register on the dates noted in the letter you received. If you did not receive your registration packet, see Cindy Irving. February 2023 Treasurer's Report: Approved report as presented. Total Operating and Reserve Liabilities and Equity are $5,471,000. April 2023 Golf Course Subsidy: Reviewed and approved Golf Course Receiver request to subsidize the golf course in the amount of $11,764. Sport Court Rule Amendments: Adopted amendments, omitting 3.3.3, 3.3.4 and 3.3.7. Item 3.1.1 amended to state, "All courts are for the exclusive use of residents and their guests. At all times, guests on the court must be accompanied by the host resident. Residents have priority regarding use of the courts." Final rule will be mailed to the membership. Golf Cart Rule Amendments: Adopted amendments to 4.5 Golf Cart. The final rule will be mailed to the Membership. Clubhouse Cameras: Accepted proposal from TVC, Inc. Quote #1696 Additional Cameras Installation in the total amount of $9,039.65. ECLM Landscape Maintenance Contract: Approved renewal from May 1, 2023 to April 30, 2026 as submitted. Includes a base maintenance cost of $93,193 Year 1 (May 1, 2023 to April 30, 2024), $95,523 Year 2 (May 1, 2024 to April 30, 2025) and $97,915 Year 3 (May 1, 2025 to April 30, 2026). Security Services Contract: Approved renewal with Dansk Enterprise, Inc. dba Nordic Security Services for a 2-year term beginning May 1, 2023 and ending April 30, 2025. Compensation to be paid monthly at $55,205 ($662,460 annually) for Year 1 and $56,500 ($678,000 annually) for Year 2. Pool Deck Concrete Replacement: Approved Construction Services and Maintenance for $323,288, plus contingency of $35,000. Oversight from Terra Pacific Consultants, Inc. of $16,164. Total is $374,452. Emergency Agenda Item-Pool Maintenance: Approved 1StopPoolPros proposal to drain swimming pool, acid wash and sand plaster, replace coping, water line tiles, pool mastic, refill pool, administration and balance chemicals. Total cost of $40,936.88. Clubhouse Lighting Retrofit and Grounds Lighting: Approved proposal of SoCal West Coast Electric at a cost of $396,191 plus contingency of $40,000. Total cost of $436,191.00. Funding from Auditorium, Clubhouse and Grounds Reserves. Inspectors of Election Proposal: Approved proposal to perform Sept. 21, 2023 annual election ballot mailing and tabulation at a cost of $7,669. Audit and Tax Preparation, Newman CPA: Approved proposal to prepare the April 30, 2023 and 2022 audit and tax preparation at a total cost of $2,500. Purchase of Additional Hand-Held Radios, Emergency Preparedness Committee: Approved purchase from Eagle Communications for Hytera TC-508 UHF Radios. Total cost of $2,954.84. 17.2 Color Scheme Selection, White Paint Option, 30-Day Member Comment: Architectural Control Committee requests addition to rule 17.2 "Color Scheme Selection." Homeowners are requesting to paint several areas of their residence with varied colors of white. Committee wants to amend the rule in "17.2.2 (h) If any white option is chosen on any portion of a residence, only one white option can be used as a stucco color, trim, or accent. Multiple white options cannot be used." Final ruling will be made at the August meeting (as the Board is dark in July). Members can reference the proposed rule amendment on page 6 of e Colony News. Online Ticket Sales: Request to provide options to buy event tickets online or in person. Approved using Ticket Spice and the WePay processing systems and purchase of iPad Pro to facilitate the application. Cost not to exceed $1,200.
