The court case is still scheduled for Nov. 17, 2023 in front of Judge
Hopp, according to Randy Robbins of the Pass Action Group (PAG).
As mentioned in last month's article, Judge Hopp is replacing Judge
Riemer who has retired. Judge Hopp has heard many civil cases,
including complex CEQA cases, such as the case filed by PAG.
PAG held a Town Hall in June at Sun Lakes. The meeting was well
attended, and the attendees were told they were on the final stretch in
the case. Consultation with PAG attorneys and PAG Board members
resulted in an announcement that PAG has raised almost all of the
money to get through the case, and possibly, even an appeals filing.
So far donations of over $300,000 have been received by PAG of
which approximately $260,000 has been spent on legal fees, filings,
and supplies supporting the case.
The Pass Action Group and their attorneys are now in a "wait
period" to see what will be needed to prevail in the case. As more
information is available, PAG will forward an update to us for our
residents.
The PAG Board of Directors thank everyone who has supported
and continues to support the efforts to stop the Banning Point
Warehouse Project.
