| THE COLONY NEWS | NOVEMBER 2023 | 9 Board of Directors Meeting Highlights 9/18/2023 Rules & Regulations Update Highlights as presented are a condensed preliminary dra until, aer review and approval by the Board at the next meeting, the minutes become official. Changes may occur. A complete copy is available in the HOA office. Notice of Sept. 18, General Board Meeting: Homeowner questioned proper notice of the meeting. General Manager and Assistant confirmed that notice was posted on the HOA office window on Wednesday, Sept. 13. Auditorium Lighting Project: Staff is waiting for the City to sign off on the final inspection. The project is under budget by $16,000. Majestic Asset Management: Fraudulent Conveyance trial starts Sept. 18. Judge amended the judgment and signed the Performance Deed of Trust. HOA will receive a certified copy to proceed with foreclosure on the golf course property. Appraisal, title fees and sheriff fees will need to be paid. Disc Golf: Although disc golf has not formally opened, a lot of people are coming to play, just by word of mouth. The golf course will establish disc golf teams that will play on Sundays. Discs are being sold in the Pro Shop, and sandwiches and beer sales have increased. Approval of the July 2023 Treasurer's Report: Approved. Total Operating and Reserve Liabilities and Equity: $5,720,000. September 2023 Golf Couse Subsidizing Request: Approved subsidy in the amount of $40,361 for September 2023. Resignation of Ron Brown, CATCOM: Accepted resignation from Communications and Technology Advisory Committee. Proposed New Exterior Lighting Rule: Tabled proposed 15.11 Exterior Lighting rule for better clarification and rewording by the Architectural Control Committee. Amendment to Painting Procedures - 28-Day Member Comment: Approved amending Article 17 – Painting Procedures, 17.3.1 for 28-Day Member Comment as recommended by Architectural Committee. Members can reference the proposed rule amendments below. Proposed Noise Rule and Amendment to Article 8, Rules and Regulations Committee: Legal Counsel informed the Board that the HOA can determine if a resident's noise level is too high based on the City of Murrieta's decibel system. This would not require creating a rule. The only amendment needed is to Article 8 – Fine Schedule for noise violations. Request for Golf Course to Advise HOA of Tournaments: To better prepare for the influx of traffic, the golf course has agreed to provide a calendar of their tournaments so Security can plan staffing. Request to Research Colony Merchandise Sale to Residents: Authorized management to research Colony apparel and merchandise (i.e., caps, T-shirts, coffee mugs, license plate covers) to be purchased by residents to promote Colony pride and community. Research Bocce Ball Court Expansion: Authorized Recreation and Fitness Advisory Committee to research expanding the Bocce Ball Courts. Shipping/Conex Container in Pool Area: Authorized Director Stevens and staff to oversee decoration of the Shipping/Conex Container in the pool area. It was suggested to incorporate greenery and a mural that could be painted by a Colony artist. e following proposed new Rules and Regulations were approved by the Board of Directors at the Sept. 18, 2023 General Board Meeting for 28-Day Member Comment (changes in red): ARTICLE 17 – Painting Procedures 17.3 Definitions. 17.3.1 STUCCO refers to the main body of the house or front door. 17.3.2 TRIM refers to fascia, relief pieces, stucco pop-outs, around windows, wood trim around garage doors, cap on stucco walls, planter shelves, front doors and shutters. 17.3.2 ACCENT refers to specific areas: the front door, the front entry wrought iron gate, and/or wood trim around the garage door.
