With the holiday season rapidly approaching, we are hoping for an early present in the form of a favorable outcome to our lawsuit against the Banning Point project. At the time of this writing, Oct. 6, 2023, our attorney, Kevin Bundy of the law firm Shute, Mihaly & Weinberger LLP has confirmed via the court docket the following information: All pre-hearing paperwork has been submitted to the court. The hearing is currently scheduled for Nov. 17, 2023, at 1:30 pm in front of Judge Harold Hopp. The hearing will be held in Department 1 at the Riverside Historic Courthouse, 4050 Main Street in Riverside. The expectation is that the hearing will last at least a couple of hours. As far as we know at this time, the hearing will be in person, as opposed to Zoom. If the hearing is in person, the public will be able to attend/observe from the gallery. Mr. Bundy also thinks that it is likely that the court will issue a tentative written opinion the day before the hearing. Please keep in mind that it is not uncommon for Superior Courts to "continue" hearings in cases such as ours on very short notice. We will be sure to send out newsletters and Facebook posts to keep everyone informed as to the dates as everything gets closer and absolute information on all matters in front of the court. The Board of Directors of the Pass Action Group (PAG) believes that we are in an acceptable financial position to get through this phase of the legal process. We would also like to continue to thank Ms. Dorrie Gartzke, and her helpers, for the recycling program she took upon herself to coordinate and help assist in funding the PAG. Recyclables can be dropped off at 6029 Spanish Trail Cove, Banning (909) 562-9226. Once again, the PAG would like to thank every supporter.
