Majestic Asset Management: President Dalfonso reported that the Fraudulent Conveyance trial is complete. e Judge requested the attorneys submit their closing arguments by Oct. 5, 2023, which were submitted. Legal counsel feels confident about the hearing results. Judge stated he has serious issues with timing in which Majestic filed a lien against the golf course. Motion for Appeal of the Golf Course Foreclosure, Oct. 20, 2023: Motion will take place on Oct. 20, 2023. Legal counsel is requesting the court set an Appeal Bond of $4.2M. If allowed, the bond will sit in a court account until the matter is settled. If Majestic does not post the Bond, the Association will set the date to proceed with foreclosure. Epsten APC also filed a motion to recover attorney fees for their efforts to enforce the judgment. Golf Course Update: On Nov. 4 the golf course will begin having food trucks on weekends. September disc golf had 404 rounds, which represents 17 percent of total rounds and raised approximately $4,000 in green and cart fees, and $1,000 in beverages. Disc golf is trending 800-1,000 rounds for October, which is about 20 percent of total. Duncan Golf Club will hold a free clinic to teach disc golf to interested residents on Nov. 3. Emergency Preparedness Advisory Committee (EPC) Container: Moved EPC Conex container to perpendicular in pool area so it is not as exposed to resident homes. ECLM will install natural bushes to cover the container. Sept. 19, 2023, Annual Election – Officers: President Bruce Dalfonso – Oversees Board meetings and Board business. Treasurer Chuck Gordon – Handles Association financials and chairs the FAC. Vice President Gregg Ross – e right-hand and back-up to President in his absence; leads Strategic Long-Range Planning. Secretary Kathy C. Stevens – Handles the signing of contracts, review of invoices and special projects: Strategic Planning (living document), new policies and committee charters. Lighting Project: Lighting is complete in the Clubhouse auditorium. e lighting has various performance capabilities and is dimmable. Approval of the August 2023 Treasurer's Report: Approved August 2023 report as presented. Total operating and reserve liabilities and equity: $5,442,000. October 2023 Golf Couse Subsidizing Request: Approved golf course subsidy of $45,415 for October 2023. New Exterior Lighting Rule, 28-Day Member Comment: Tabled for further review and amendments by the Architectural Control Committee. Amendment to Article 8–Fine and Penalties Schedule, 28-Day Member Comment: Tabled to allow for additional changes. Repair and Paint Pool Area Planter Walls: Approved Certa Pro Painters to repair and paint the pool area planter walls for the total amount of $4,750. Approval to Research: Gate Entry Realignment: President requested approval to research other gate entry options to reduce back-up at the main gate. One alternative is to direct vendors to enter through the Nutmeg Gate. Approved. ECLM Appreciation Luncheon hosted by Landscape Advisory Committee: Approved LAC hosting appreciation luncheon for Environmental Concepts Landscape Maintenance employees at a cost of $770.73. Luncheon provided by MSR. Front Lawn Restoration: Approved rabbit mitigation, owl boxes and trail cameras to assist with front lawn restoration before reseeding. Audio/Visual Updates, Loudspeakers System and Amplifiers, Wireless Microphone System and Equipment Rack Relocation: e Board approved D&B Audiotechnik loudspeaker system and amplifiers ($48,448), wireless microphone system ($38,114), and equipment rack relocation ($15,000) as provided by Sound Image for a total cost not to exceed $101,562. Reserve items. Level 3 Reserve Study without a Site Visit, ARSolutions: Approved proposal at a cost not to exceed $3,475.
