Fraudulent Conveyance Update: Judge voided the $3.4M lien placed on the golf course by Majestic Asset Management and awarded Association the right to attorney fees. Judge determined the Huangs were functioning in their alter egos, and therefore were found personally responsible. Judge continually referred to the Huangs' inconsistencies. e Association's attorney Rian Jones will be retiring at the end of December. is was his last trial. Golf Course Foreclosure: Remains at the Appellate Court and will continue to run its course, which could be another 1–1.5 years. Golf Course Update: Disc Golf rounds for October 2023 were over 600+. Access Control System: Several residents expressed concern with their vehicle transponders not working properly. Many of the issues have been corrected. Violations: Reminded homeowners they have the option to go to the HOA office to view video in advance and pay their violation, or appeal to the Board. Approval of the September 2023 Treasurer's Report: Approved. Total Operating and Reserve Liabilities and Equity: $5,528,000. November and December 2023 Golf Course Subsidy Request: Approved subsidy of $50,000. Approval of Lien, Account #00242-8680: Approved lien due to delinquent assessments exceeding more than $1,800, or 12 months delinquent. Article 5, Section 5.4 Estate Sales: Tabled final approval of rules to allow for further review. Article 17 Painting Procedures, Final Approval: Adopted amendments as presented. Article 3 Sports Courts Rules, Final Approval: Adopted amendments as presented. Resignation of Gerald Stein, Architectural Control Committee: Accepted resignation. His contributions to the Committee are greatly appreciated. Amendment to Pool Rule Rev. 2.1 Hours, Recreation & Fitness: Tabled publishing for 28-Day Member Comment to allow for further review. Amendment to Pool Rules, Food and Drinks: Tabled publishing for 28-Day Member Comment to allow for further review. Amendment to Article 8 – Fines and Penalties: Tabled publishing for 28-Day Member Comment to allow for further review. Proposed Revisions to Nuisance Rules: Tabled publishing for 28- Day Member Comment to allow for further review. Dumbell Man Fitness Equipment Contract Renewal: Approved Maintenance Agreement at a quarterly rate of $185 per visit for one year. Approval of 2024 PCM Holiday Schedule: Approved.
