After the December Lifestyles was approved for publication, we learned that Judge Hopp continued (postponed) the hearing on our Petition for Writ of Mandate to Jan. 31, 2024, at 1:30 pm. Because of the continuance, we are waiting again for a decision, rather than discussing and strategizing after learning the outcome of our case. The continuance was not requested by any of the parties. The Court provided no reason for the continuance, and nothing should be read into his decision. This is not unusual in litigation. At this point, any delay is in our best interest, because it postpones the project and puts pressure on our opposition. Another continuance is always a possibility. Although the gallery is open to the public, the members of the gallery will not be allowed to speak and courtroom decorum would be expected to be respected and always followed. Members of the Pass Action Group Board of Directors plan to attend. 1. Administrative Record: The administrative record which was developed many months ago contains all the information related to the case. This was developed in a collaborative effort with our attorneys and the opposing attorneys. 2. Briefs: The briefs from both sides – an opening brief filed by P.A.G., a respondent's brief filed by our opposition, and a reply brief filed by P.A.G. - were submitted to the courts months ago as well. This is where both sides have the initial opportunity to express their interpretation of the case/administrative record. 3. Judicial Review: Prior to the hearing, Judge Hopp will have reviewed the Administrative Record and all of the briefs. It is expected that Judge Hopp will issue a tentative ruling just prior to the hearing. 4. Hearing: The hearing will consist of Judge Hopp questioning the attorneys using the Administrative Record and Briefs as the baseline. Unlike planning commission or city council meetings, no public comment is allowed. Our case is now in the hands of the attorneys as officers of the court. 5. Conclusion: After the hearing, Judge Hopp will issue a ruling. The ruling may be immediate or in the future. We simply do not know. Please contribute at www.givebutter.com /passactiongroupbanning HEARING CONTINUED, RESCHEDULED 2024 ANNUAL MEETING OF THE MEMBERSHIP AND ELECTION OF DIRECTORS The Sun Lakes Country Club Homeowners Association Annual Meeting of the Membership and Election of Directors is Wed., April 10, 2024, at 9 am, in the Main Clubhouse Ballroom. There will be three open positions on the Board. Each newly elected director will serve a two-year term. Any homeowner interested in running for the Board of Directors should fill out a candidacy form. The candidacy form will be available in the Administration Office beginning Mon., Jan. 8, 2024, and must be returned no later than 5 pm on Wed., Feb. 7, 2024. The Inspector of Election will review each candidacy form it receives and place all eligible candidates on the ballot. A "Meet the Candidates" forum will be conducted in the Main Clubhouse Ballroom. Members will be given the opportunity to ask questions of the Board candidates. The Forum will be held on Wed., March 6, 2024, at 4 pm. The Member of Record date is Wed., Feb. 14, 2024, and ballots will be mailed to each homeowner on Fri., March 8, 2024. Election information will be posted on the Sun Lakes website www.sunlakescc.com and on the bulletin board, in the Main Clubhouse, adjacent to the receptionist desk. 2024 BIENNIAL DISTRICT DELEGATE AND ALTERNATE DISTRICT DELEGATE ELECTION The Sun Lakes Country Club Homeowners Association District Delegate and Alternate District Delegate Elections are held in conjunction with the SLCC HOA Annual Meeting of the Membership and Election of Directors. The District Delegate and Alternate District Delegate election results will be tabulated by the Inspector of Election on April 10, 2024. Each newly elected District Delegate and Alternate District Delegate will serve a two-year term. Any homeowner interested in running for District Delegate or Alternate District Delegate should fill out a candidacy form.
