Architectural Wrought Iron Fence Appeal: Homeowner Jon G. Burke appealed the ruling to deny the installation of his decorative wrought iron fencing. e committee deemed it not conforming aesthetically. Ruled to uphold the appeal and approve a variance to install the wrought iron fence under the condition the height of the fence cannot exceed 5'6" (to include the exiting concrete wall) and must be black in color. Directed the ACC to create new fence guidelines. e Board will provide their fence ideas for review with the committee. Approval of the December 2023 Treasurer's Report: Approved as presented. Total Operating and Reserve Liabilities and Equity: $5,075,000. February 2024 Golf Couse Subsidizing Request: Approved subsidy in the amount of $41,336. Approval of Lien, Account #00133-0164: Approved lien due to delinquent assessments of more than $1,800.00, or 12-months delinquent. Approval of 2024-2025 Reserve Study: Approved as presented. Approval of the 2024-2025 Budget: Approved. Effective May 1, 2024, assessments will increase from $320 to $333 per month. Architectural Standards, 17.2 Color Scheme Selection, 17.2.2 Garage Gasket: Approved amendment. Garage gaskets must be painted the color of the garage door or wood trim around the garage door. Architectural Standards, 17.3 Definitions: Adopted amendment 17.3.1, which states, "STUCCO refers to the main body of the house." Nuisance Rule Amendments: Approved for 28-Day Member Comment. Members can reference the proposed rule amendments on page 7 (Below) of e Colony News. Estate Sale Rule Amendment: Tabled for further review. Exterior Lighting Rule: Tabled for further review by the Architectural Control Committee. Palm Tree Removal: Approved the Environmental Concepts Landscape Maintenance proposal of $3,746 to remove two Mexican Fan palm trees are showing significant leaning. Trip Hazard Removal: Approved SoCal Seal LLC to resurface sections of concrete on walkways in G-9, G-14, G-15, G-16, G-17, G-33 and G-41 areas in the amount of $3,410. Annual Tree Review Removals and Plantings: Approved ECLM proposal of $404. Clubhouse Media: Approved Director Matteucci's recommendation for management to review all Clubhouse media for areas of improvement (i.e. fitness room TVs, internet, etc.). Replacement of Clubhouse Water Heaters: Approved Generations Plumbing to replace with a 75-gallon gas water heater and 65-gallon electric water heater at a total cost of $9,212.38. continued from previous page e following proposed new Rules and Regulations were approved by the Board of Directors at the Feb. 15 General Board Meeting for 28-Day Member Comment: 5.10 Nuisances 5.10.1 No Owner shall permit anything to be done or kept upon such Owner's lot or the Common Area which will obstruct or interfere with the rights of quiet enjoyment of the other surrounding residents; 5.10.2 No Owner shall annoy with unreasonable noises, permit any nuisance, or allow any illegal act to be committed within the Community. 5.10.3 Each Owner shall comply with all of the requirements of local, county and state governmental and/or regulatory authorities with respect to said premises, and shall remove all rubbish, trash and garbage from Owner's lot. 5.10.4 All clothesline, refuse containers, woodpiles, storage boxes, tools and equipment shall be prohibited from any lot unless obscured from view by a fence or appropriate screen approved by the Architectural Control Committee. 5.10.5 Quiet Enjoyment Violations for unreasonable Noise will be consistent with the City of Murrieta standards established in the most current General Plan - Noise Element, and the City of Murrieta Municipal Code ยง16.30 Noise. e Standards for Exterior Noise generated by an individual lot shall not be exceeded for a cumulative period of more than thirty (30) minutes in any eight (8) hour period. 5.10.6 Unreasonable noise does not include temporary noises such as in-person or telephone conversations held within Owner's yard and/or patio; home improvement/contractor activities; conversations between neighbors/friends within, or in front of, Owner's lot; periodic community social or recreational events within e Colony; or golf course activities.
