| SUN LAKES LIFESTYLES | SEPTEMBER 2024 | 5 At the time of this writing, we are anticipating the City Council meeting of Aug. 27. To reiterate last month's article, the Council should have a resolution on the agenda to deny the project all together. This denial is a best case for the Pass Action Group and the communities. It is very possible that the developer's attorney will ask for recusal from multiple Council members. Unfortunately, should the developers challenge certain aspects including recusals this could lead to new court cases. Ideally, the Council will vote to deny the project and the developers will "go back to the drawing board" and submit a new project that will have to go through the same process that Banning Point went through. The upside is the community and City of Banning will not be "caught with their pants down" this time and will review the project and meet any deadlines for contesting, if necessary. Unfortunately, every delay means more work for the Pass Action Group and our attorneys. Claims must be reviewed, motions filed and conference calls with the P.A.G. legal committee.
