Majestic Asset Management Litigation Fraudulent Conveyance: The Judge finally signed off on the Fraudulent Conveyance Order, favoring the Association and opposing Majestic Asset Management, Hai and Jen Huang and Tsu Jen (TJ) Chu fraudulent lien they placed on the golf course in the amount of $3.4M. Majestic has 30-days to appeal the order, estimated to be Oct. 20, 2024. Golf Course Foreclosure, Appellate Court Update: The Court is in the process of scheduling oral arguments and will not allow any further briefs from The Colony or Majestic. Golf Course Update: August revenues, rounds, gross profit and net operating increased from last year. September started out very poorly due to summer heat. When the heat let up, there was an increase in play. They will be repairing all leaking valves for the center playing areas. Other Business 2024 Annual Election: The Inspectors of Election received 924 Ballots as of Sept. 17. The deadline to get Annual Election Ballots is Wednesday, Sept. 18 by 5 pm. September 2024 Golf Course Subsidy Request: Approved subsidy request in the amount of $40,886. July was a bad month with net losses of $66K for the course due to the extreme heat, maintenance repairs and utility increases. Approval of the July 2024 Treasurer's Report: Approved as presented. Total Operating and Reserve Liabilities and Equity: $5,749,000. The Association is rebuilding their equity. Approval of Liens: Approved Filing Liens against Account #133-5716 and Account #233-5647 due to delinquent assessments in excess of $1,800 or 12-months delinquent. Estate Sales Rule Amendment: Approved amending the recently adopted Estate Sales rules to require, "At least one day prior to the estate sale, the owner or agent of the estate sale shall provide a guest list to the HOA Office, by 5 pm, of those who have been given an appointment time. No additions to the appointment list can be made after the deadline for submission." Article 4 – Vehicle & Access Rules: Tabled for further research and discussion. Landscape Maintenance Standards & Guidelines, Sections 25.1.3 Stone Mulch and Section 23.1.5 "Welcome" Flags: Approved proposed amendments to the Landscape Maintenance Standards & Guidelines, Sections 25.1.3 Stone Mulch and Section 23.1.5 "Welcome" Flags for 28-Day Member Comment. Final adoption will be at the January 2025 meeting. Replacement of Mini-Split HVAC Systems in Communications Room: Approved CSR Air Conditioning and Heating, Inc. to supply and install a new Sea Breeze 18,000 BTU Ductless Mini Split System with new line set in the Communications Room for a total cost of $6,300. Funding is from Reserves. Ratify Replacement of the Current Pool and Spa Maintenance Service: Accepted Breakpoint Commercial Pool Systems proposal to provide maintenance service to the Clubhouse Pool and Spas at a monthly cost of $1,125. Approval to Host City of Murrieta Candidates Forum: Approved hosting in The Colony Clubhouse Auditorium. Management will plan event for some time in October 2024. BOARD OF DIRECTORS MEETING HIGHLIGHTS: SEPT. 17, 2024 Proposed new rules, or amendments to existing rules, require a 28-day member general notice (comment) period. e following proposed changes to "e Colony Rules and Regulations" have been approved by the Board to begin the general notice (comment) period. Any Member Comments regarding the proposed changes may be emailed to Kimberly Evans at Kimberly.evans@pcminternet.com. Comments on the proposed changes will be submitted to the Board for its consideration. Article 25 – Landscape Maintenance Standards and Guidelines Section 25.1.3 regarding Stone Mulch. All installations of stone mulch or river rock in the front or side yard must have the area prepared by the landscape Contractor to avoid damage to the irrigation below. Stones can be provided by the homeowner (sample provided to the LAC and LS for approval), or can be purchased and installed by the Contractor. Any stone mulch or river rock must conform to the approved stone palette. Section 25.1.5 regarding "Welcome-Type" ags. Pots, statues, artifacts (man-made items), or lawn furniture are not permitted in/on front yard lawns, planter areas, walkways, driveways, tree wells, or hanging from the trees. An exception is made for the fabric "Welcome type" f lags with the limit of one per household, and these may only be placed in the planter area. Neither the maintenance crews/contractor nor the Association is liable for any damage to items placed by the homeowner outside their gate in the front yard. RULES AND REGULATIONS
