FOUR SEASONS BREEZE | DECEMBER 2024 27 Most of the articles that ARC places in the Breeze begin with a homeowner question or when we see a rapid uptick in applications for a particular product that ARC does not see very often. Recently, ARC members have received several questions concerning house painting. These include questions about applications to paint, questions about how often to paint, and various contractors. Painting of the exterior of a home requires approval by ARC. That approval can only be granted after an application has been submitted and approved by a majority vote of the ARC Committee, even if there is no change to the current color scheme. Painting of less than the whole house also requires ARC approval. Small repairs and paint touch up of a small area do not require approval. There are no painting contractors who have been identified as "preferred painting contractors." All homeowners are free to choose the contractor they want to do the work. Neither ARC nor the management company has any input in who you use to paint your house. Any contractor who claims or suggests that they are a "preferred" painter or that they are ARC's favorite are simply not being truthful. Any contractor who represents that they have or can get automatic approval by ARC is not being truthful. All painting must be approved through the normal application process. As stated in the Architectural Guidelines and Standards, "Failure to obtain necessary approval from ARC … may constitute a violation of the CC&Rs and may require modifications or removal of any work at owner's expense." There is no mandatory time line when a home must be painted. It has come to ARC's attention that one or more painting contractors are claiming that every house must be painted every 10 years. This is not a requirement. Homes must be kept in good condition including the paint, however, there is no set time line for repainting. Finally on this matter, ARC is aware that one or more painting contractors are demanding deposits that exceed the amounts allowed by the California State License Board. ARC does not enforce the State law that limits down payments to 10 percent of the total job or $1,000 which ever is less. Homeowners should be wary of contractors that fail to follow State laws. ARC has also received several questions concerning f lags and f lag poles. Guidelines refer to the City of Beaumont Zoning Codes for f lags and f lag poles. The City code restricts the number of f lags on residential properties of the size located in Four Seasons Beaumont to three f lags and one f lag pole. The maximum f lag pole height is 20 feet, and the maximum area of each f lag is 40 square feet. No f lag displaying commercial messages, images or symbols may be displayed in residential areas. Beaumont City requires a permit to install a f lag pole. Guidelines require all f lag poles to be located at least 5 feet from property lines. In addition, no f lag may extend over property line fences or walls at any time. If you have questions or need assistance, please contact me, or attend our next ARC meeting.
