6 | THE COLONY NEWS | OCTOBER 2025 | BOARD OF DIRECTORS MEETING HIGHLIGHTS: AUGUST 21, 2025 Highlights are a condensed dra of the Open Session minutes. Majestic Asset Management Litigation: President Bruce Dalfonso informed the Membership that court proceedings were held on August 20, 2025. e Association sought attorney's fees related to the appeal of the Foreclosure Judgment and the value of the Performance Deed of Trust. e court awarded the Association $121,000+ in attorney fees. To date, the Association has been placing liens on the golf course for outstanding attorney's fees, totaling approximately $460,000. In addition, the Association currently holds liens against the golf course amounting to $2.2 million, which include attorney's fees and the monthly golf course subsidy payments. ese liens help secure the Association's position in the event it is outbid during the golf course auction process. Golf Course Update: Mr. Dalfonso reported that despite the hot weather, golf course revenue is up 7%, and rounds played have increased by 14%. Disc golf participation has remained steady and costs the Association nothing, as it was installed by a local disc golf club. e Association continues to subsidize the golf course each month. e primary objective is to keep the greens maintained and the doors open. While the greens are in the best condition they have been in years, limited funding has prevented adequate upkeep of the tee boxes and bunkers. e Receiver is currently obtaining bids for pond treatments to control mosquitoes and algae build-up. ey will also begin tree trimming within the next month. CC&Rs, Article 20: President Dalfonso reported that he received a few calls from homeowners with questions regarding Article 20. He encouraged homeowners to reach out to Board members with any questions on this article, noting that the Board is happy to assist. Annual Election Ballots: Mr. Dalfonso informed the membership that the Annual Election Ballots were mailed out on August 15, 2025 and a majority of the membership should have received their Ballot by now. If you have not received your Ballot, please contact the Inspectors of Election or the HOA Oce. Candidate Forum: President Bruce Dalfonso announced that the Meet the Candidates Forum will be held on Tuesday, August 26, 2025, at 5 pm in the Clubhouse Auditorium. He encouraged homeowners to attend in order to hear from the Board Candidates, which will assist them in making informed decisions when casting their ballots. Annual Election: Mr. Dalfonso announced that the Annual Meeting of the Membership and Election of the Board of Directors will be held on ursday, September 25, 2025, at 1:00 PM in the Clubhouse Auditorium. e launch of the new Association website will be presented during the meeting, and refreshments will be served. Assembly Bill 130: President Bruce Dalfonso informed the Membership that AB130 limits Association nes to health and safety issues only. e Board is working with Legal Counsel to review and update the Association's Rules and Regulations, specically Article 8 – Fines and Penalties, to ensure compliance. He also noted that other organizations are currently challenging this rule in Sacramento, and the Board will keep the Membership updated. Accident Outside Cal Oaks Gate: With great sadness, President Bruce Dalfonso announced that longtime resident Patricia Garner was involved in a tragic car accident outside the Cal Oaks Gate on California Oaks Road, which resulted in her untimely passing. In response, the Board requested a meeting with the City of Murrieta to discuss safety concerns and potential preventative measures. e City promptly met with the Board and has since taken several steps, including adding DUI checkpoints (per legal requirements), installing a "Signal Ahead" ashing sign, trimming back trees near the Cal Oaks Gate, increasing police presence and social media awareness, and evaluating adjustments to the trac light timing outside the Cal Oaks gate. While the City is making every eort to reduce the risk of future accidents, no measures can fully eliminate the possibility. Mayor Cindy Warren expressed her appreciation for the emails and comments she received from the community. President Dalfonso emphasized that the City of Murrieta has a strong, responsive governing body that is both attentive and committed to the community's concerns. August 2025 Golf Course Subsidizing Request: e Board approved the August 2025 subsidy request for the golf course in the amount of $45,420. e subsidy will be used for tree trimming expenses. Treasurer's Report: e Board unanimously approved the unaudited Treasurer's Reports for May and June 2025 as presented. As of May 2025, Total Operating, Reserve Liabilities, and Equity were $5,997,000, and as of June 2025, the total was $6,069,000. It was noted that there was a net gain of $98,000; however, these funds may be needed to cover increased water and electricity expenses. Continued on next page
