Comments on the proposed changes will be submitted to the Board for its consideration. ARTICLE 8 - FINES AND PENALTIES This Schedule is established pursuant to Article 8, Section 8.5, of the Declaration of Covenants, Conditions and Restrictions for The Colony at California Oaks (CC&Rs). In accordance with Civil Code Section 5850 and the Association's Governing Documents, the Board hereby approves and ratifies the following fee schedule for violations of the Association's Governing Documents including Rules & Regulations and CC&Rs. This schedule applies to Owners, tenants and lessees. Owners shall include a provision in their rental or lease agreements requiring their tenants and lessees to abide by the Association's Governing Documents. The Owners shall be responsible to the Association for the payment of any fines imposed pursuant to this schedule, and any costs incurred by the Association to obtain compliance with the Association's Governing Documents. California Assembly Bill (AB 130) AB 130, passed by the 2025-2026 legislature was effective July 1, 2025, and amended Sections 5850 and 5855 of the California Civil Code (CCC). The amendments change the existing law to cap fines for violations at $100 unless the violation results in an adverse health and/or safety impact. The amendments to the law do not specifically define "adverse health and/or safety impact". The amendments do, however, allow the Board to adopt a written finding in an open board meeting, on the violations that pose a health and/or safety risk for that association. Article 8 is amended to establish those written findings. "Health and safety" is considered to include, but not be limited to, the well-being and protection of individuals from harm. To qualify for a health and safety exception that allows for fines exceeding $100, the Board must adopt written findings in an open session board meeting. The Colony Board of Directors identifies the following categories as "health and/ or safety-related violations" in the community including, but not limited to, (1) maintenance issues or violations affecting the structural integrity of common areas or individual lots, which might pose a risk to residents (this would include the improper use of gates resulting in potential damages to association property, vehicles, and persons); (2) parking in areas that limit visibility or restrict access [such as fire lanes], that expose people to a potential risk of harm; (3) vehicular violations - exceeding the posted speed limit, failure to stop at stop signs, reckless driving; (4) disorderly conduct (physical altercations); and (5) dog bites resulting in injuries to people or pets. In accordance with Tables 8-1 and 8-2 below and the Association's Governing Documents, the Association may levy fines (referred to as "Compliance Assessments"). These fines shall constitute personal obligations of the Owners who are fined and shall be billed in the same manner as the monthly assessment. Copies of the Governing Documents are available to Owners at The Colony Homeowners Association's office, and/or can be mailed upon request and payment of applicable fees. Any suspension of community privileges may include deactivating a vehicle transponder. Violations stay on the homeowners' address for a rolling 24-month period of time and are then removed.
