Writ for Sale of Golf Course President Stevens presented an update on the Writ for the Sale of the golf course. The Writ was sent to the Sheriff on Oct. 20, 2025; however, the Sheriff declined to process the Writ due to a misunderstanding of the court's judgment for foreclosure and the role of the performance deed of trust in the process. The next hearing is scheduled for March 9, 2026, wherein legal counsel will ask the court to require the Sheriff to process the Writ. Colony Creek Properties, LLC In response to several questions from residents, President Stevens provided an overview of the Colony Creek Properties, LLC. In June of 2022, the board submitted Articles of Organization and Statement of Information for a Limited Liability Company (LLC) to be the separate legal entity to operate and maintain the GC. The name of the LLC is Colony Creek Properties, LLC., and it is owned by the HOA corporation. Since the Board of Directors represents the corporation, a member of the Board signed the paperwork to establish the LLC. Colony Creek Properties LLC and its bank account under that same name are assets of the HOA. No individual owns the LLC. Upcoming Events The President's message announced upcoming events in The Colony, such as the Ladies Clothing Swap, the Community Document Shredding event, the Senior Mental Health Resource event, and the upcoming Budget Workshop. Golf Course Subsidy The Board ratified the December 2025 subsidy request for the golf course in the amount of $45,855, approved the January 2026 subsidy request in the amount of $46,715. Treasurer's Report October 2025 Financials The Board unanimously approved the unaudited Treasurer's Report for October 2025 as presented. As of October 2025, Total Operating, Reserve Liabilities, and Equity were $5,686,000. November 2025 Financials The Board unanimously approved the unaudited Treasurer's Report for November 2025 as presented. As of November 2025, Total Operating, Reserve Liabilities, and Equity were $5,729,000. Lien(s) The Board approved Witkin & Neal to file liens against Account #00247-2092, Account #00133-3954 and Account #00133- 1008 due to delinquent assessments in excess of $1,800 or more than 12 months delinquent. Authorization to Foreclose The Board approved Witkin & Neal to file a Notice of Default (foreclosure) against APN #947-250-053. Amendment of Article 8 - Fines & Penalties, 28-Day Member Comment The Board approved the revisions to Article 8 – Fines & Penalties to comply with AB130 to be published in e Colony News Magazine for 28-Day Member Comment. Emergency Agenda Item, Approval of Jim Selth, Finance Advisory Committee The Board approved adding Jim Selth to the General Agenda for approval as a new member of the Finance Advisory Committee, enabling his participation in the review of the financials for the upcoming 2026–27 budget preparation. Jim Selth, Finance Advisory Committee The Board approved Jim Selth to become a new member of the Finance Advisory Committee. 2026 PCM Holiday Schedule The Board approved the 2026 PCM Holiday Schedule as presented. G-19 Turf Renovation (Bualo Grass) The Board approved the Landscape Advisory Committee's recommendation to renovate G-19 as a turf project, consistent with SoCal Water Smart rebate requirements and future water-use regulations, supporting responsible landscape management. Water Feature Repair at Jackson Avenue Gate The Board approved Suntech Builders to repair the water feature at the Jackson Avenue Gate at a cost not to exceed $8,797. ermoplastic Polyolen (TPO) Roong Refurbishment The Board approved TMC Roofing to reinforce the Clubhouse flat built up TPO roofing for a total cost not to exceed $34,500. Main Gate Barrier Arms (2) Replacement The Board approved Superior Gate Services to replace the Resident and Guest entry barrier arms at Jackson Avenue for $13,580.
