PROPOSED RULE AMENDMENT NOTIFICATION Rule changes concerning Golf Course Rules and Regulations PROPOSED RULE CHANGE NOTIFICATION 13-005 The Board reviewed the following proposed amendment, to the Sun Lakes Country Club Homeowners Association General Statement of Rules and Regulations that appear in the Association's 2013 Local Phone Book, Sun Lakes Edition (reference pages 41-42), at its September open session meeting. The Board will vote upon the proposed amendment at its Nov. 21, Open Session Meeting, following publication. If the Board votes in favor of the proposed rule change it would go into effect Jan. 1, 2014. Changes are reflected in bold, italic and underlined print. GOLF COURSE RULES AND REGULATIONS All guests of a resident must be accompanied by a Sun Lakes resident. Sun Lakes residents are responsible for the actions of their guests and will be held accountable for all violations of the golf course rules and dress code by their guests. All rules apply to golf courses and practice facilities. THE FOLLOWING GOLF COURSE RULES AND ASSOCIATED PENALTIES ARE STRICTLY ENFORCED: • All golfers must check in at the Pro Shop prior to teeing off. • If you begin your round after 5:00 PM, or anytime Pro Shop is closed, you must sign the after-hours player's roster located in front of the Pro Shop doors. You must sign in all players in your group, including guests. Any player, annual or not, observed playing without signing the "After Hours Player's Roster" will be charged for that round of golf at the appropriate rate. • Players who are physically unable to walk from the cart path to the green must obtain clearance from the Pro Shop staff to drive their carts any closer to the greens. All Applicants must provide evidence of their disability bi-annually, and purchase the approved handicap flag from the Pro Shop. All handicap flags must be clearly recognizable and maintained in good condition. Applications in Pro Shop. • Golf carts must stay on the cart path around tees and greens and on all par 3-golf holes unless the 90-degree rule is posted. • Unless walking or playing with an odd number of golfers, all players are required to share a golf cart with a playing partner. Golfers with legitimate excuses may request permission to use an individual cart prior to the start of their round of golf from the Pro Shop. • All privately owned golf carts must be registered with the Property Services Department and display the assigned Association registration number, before being driven on the golf course or on any street or Common Area within the Sun Lakes Community. The permit must be placed on the front lower windshield. • Pets of any kind are prohibited from being on the golf course and practice facilities. • Retrieval of balls hit into water hazards must be accomplished without delaying play. "Fishing" (retrieving multiple balls) is prohibited. • Sun Lakes range balls are prohibited from being used on the golf course and/or removed from the driving range. A fine of $25.00 will be imposed for an infraction of this rule. • Players must comply with the Sun Lakes Facility Dress Code. • All players are required to repair all divots and ball marks. • Verbal abuses and/or threats while using the Association's golf facilities are prohibited. • Physical confrontations while using the Association's golf facilities are prohibited. • All Sun Lakes Country Club Homeowners Association golf course facilities are part of the Association's common areas and are therefore under the direct control and authority of the Board of Directors. • Use of any portion of the Association's golf course facilities for non-golf related activities requires the specific approval of the Board of Directors prior to such use. • At all time, use of the golf course facilities by residents and their guests is done so at the risk of the individual(s) using the facilities. • All Guests must be accompanied by a legal resident at all times while on either of the two courses, practice facilities and the driving range. The following process for violations to be determined after discussion with the BOD 52 | sun lakes lifestyles | october 2013 | community news The penalties for violations of the above rules are as follows: 1st offense – Warning citation 2nd and each subsequent offense within one year of first offense – Scheduling of a Disciplinary Hearing before the Golf Advisory Committee. 3rd offense Hearing before the Master Board of Directors. Exception: Any violation of Rules #12 and/or #13 will result in the scheduling of a Disciplinary Hearing before the Board of Directors and the possible loss of golf privileges for up to 30 days, a fine of up $100 or any other discipline as may be determined legally appropriate. Additionally, any possible action involving resident conflict with management personnel or staff shall be sent directly to the Master Board for review and resolution. GOLF MEMBERSHIP REFUND/CREDIT POLICY • Upon request, 50% of the unused portion of an annual Sun Lakes golf membership belonging to an individual who passes away will be refunded to the estate of the deceased member. • There shall be no other refund of credit for the unused portion of an Annual Sun Lakes Golf Membership. Written requests for refund must be submitted using the Sun Lakes Country Club Request for Refund of Annual Golf Dues for Disability Reasons to the Director of Golf. Disability must prevent golfer from playing golf for a minimum of 90 days. Refunds are calculated at the rate of $230 per month for remaining full months (i.e., no partial months) and will be made within 60 days of approval by the Master Board of Directors.
