50 | sun lakes lIfestyles | auGust 2015 | CommunIty news The Board reviewed the following proposed amendment, to the Sun Lakes Country Club Homeowners Association General Statement of Rules and Regulations (revised February 2, 2015 edition), that appear on the Association's website (www.sunlakescc.com) and are available in the administration office (please reference Article V – Planning and Compliance - see pg. 22), at its June 25 Open Session Meeting. The Board will vote upon the proposed amendment at its Sept. 17 Open Session Meeting, following publication in the August 2015 edition of Lifestyles. If the Board votes in favor of the proposed rule change it would go into effect Oct. 2, 2015. Notice, informing the members of the approval, would be posted in the Main, North and South Clubhouses, in agreement with Civil Code § 4045. PURPOSE: The purpose of the proposed rule change is to clarify lease renewal payment dates for Recreation Vehicle Storage Area members as well as resident pass restrictions. EFFECT: The effect of the rule change, if adopted, would allow action to be taken quicker on lessees who have not renewed by Dec. 15 of each year. Furthermore, it restricts residents to six parking passes within a 60 day period. It is proposed that the following rules, in bold, italic and underlined text be added to the following subsections (5.09) of Article V – Planning and Compliance. 5.09 RECREATiOnAl VEHiClE STORAGE AREA RUlES AnD REGUlATiOnS 3. A RVSA lease runs from January 1 – December 31. Lease renewal agreements or notice of non-renewal will be mailed out in November. Leases must be signed and returned to the SLCC administration office with the associated annual fees, current registration and documentation no later than December 15. If a lessee fails to meet this deadline, a letter of non-compliance will be mailed on December 16, giving thirty (30) notice. If no action is taken by January 16, a lease will be considered out of compliance and could be subject to fines according to the Sun Lakes Country Club schedule of fines and fees and the vehicle(s) will be removed from SLCC property, in accordance with all applicable laws, Vehicle Code §22658 at the owner's expense. If a lessee fails to meet this deadline, it will be assumed they do not intend to renew their lease and the space will be deemed available as of January 1. 6. Failure to comply with the RVSA Rules and Regulations and/or the SLCC lease agreement will result in a written warning followed by a fine in accordance with Sun Lakes Country Club Owners Association schedule of fines and fees. If, thirty (30) days after the date of the courtesy notice, the lessee remains out of compliance, the lease will be terminated and the vehicle(s) will be removed from SLCC property, in accordance with California Vehicle Code §22658 (a), §22658 (f ), §22658 (g), §22658 (k), §22658 (l) and §22953, at the owner's expense. 5.09 RECREATiOnAl VEHiClE STORAGE AREA RUlES AnD REGUlATiOnS 18. No resident may obtain an overnight pass for more than six (6) calendar days, whether consecutive or non-consecutive. After the sixth (6th) day, the resident may not obtain another overnight pass, for any registered vehicle, for a minimum of sixty (60) days, without prior written approval by the Board of Directors.
