Marijuana has been touted as a way to ease the back and
joint pain many of us suffer as we grow older. With recent
changes in the law, you may have wondered if you could grow
your own (for medicinal purposes). Short answer: No, at least
not outside.
The Adult Use of Marijuana Act (Proposition 64) legalizes
marijuana for personal use in California. Under state law,
residents can grow up to six plants per household so long as
those plants are kept out of public view. The law also states
that cities or counties can impose reasonable regulations on
homegrown cannabis.
Hemet has done so. The Hemet ordinance allows no more
than six living marijuana plants inside a private residence.
Outdoor plants can only be grown in an enclosed and locked
structure (a greenhouse, for example). There will undoubtedly
be litigation over what constitutes "reasonable" in this context,
but Hemet's ordinance compares favorably to regulations by
other localities which require costly permits before allowing
even indoor plants.
Our Design Guidelines do not specifically address
construction of backyard greenhouses although the prohibition
against free-standing detached structures would appear to rule
them out.
