SOLERA DIAMOND VALLEY | OCTOBER 2022 3 Board Message By Robert Vise, Board President This is the next installment of information of our Governing Documents. Rules & Regulations serve only as a supplement to the Association's existing Governing Documents. Information below is not all-inclusive list of rules, regulations, and responsibilities of every homeowner. I will provide keys points. All information is on the SDV website under Governing Documents. Section III Maintenance Covenants and Use Regulations (continue 3.2) Animal Regulations: No commercial or farm livestock, including poultry, may be kept in the Community. Up to 2 dogs or cats or other common domestic pets may be kept in each residence, subject to local ordinances. No Person may keep any animal that is determined by the Board to be a nuisance to other residents in the Community. The Board has the power and discretion to determine whether the types or numbers of animals kept on a lot are a nuisance, & the Board will have the power to abate the nuisance through any legal procedure that is available to the Association. This includes excessive barking & pets that may become dangerous or attack or otherwise interfere with the freedom of movement of persons & other pets in the Community. Animals belonging to residents or guests in the Community must be kept in the residence or in fenced areas of the Lot. If an animal is taken outside of the residence or fenced areas of the Lot, it must be kept under the control of a person capable of controlling the animal, either on a leash or other appropriate restraint. No pet will be left unattended in the Association Common Areas. Each Owner will be absolutely liable to each and all remaining Owners, their families, tenants, residents, and guests for damages or injuries caused by any animals brought or kept in the Community by an Owner, members of the Owner's family, or by the Owner's guests, tenants, or invitees. Each Owner will immediately remove, and properly dispose of, any excrement or clean other unsanitary conditions left by the Owner's animals on any portion of the community. The above items are included in the CC&Rs, however the following items are additional rules: No pets, other than legitimate service animals, are permitted in the Clubhouse, tennis courts, pickleball courts, pool areas, or bocce courts. Service animals must be registered with the Association & verification of the animal's status must be provided. Pets are not allowed on the property of another owner without permission. Trash: Trash must be stored in sanitary trash containers supplied by a waste management company. No trash containers, or recyclable materials may be stored in view of other Lots or Association common areas. However, trash containers may be set out at curbside for a reasonable period of time on trash collection days (not to exceed twelve (12) hours before & after scheduled trash collection hours). At all other times, Owners must store closed trash containers in the garage or in a fenced yard area, out of sight of other Lots and Association common area, until scheduled collection times. Owner-Installed Improvements: No Person will install any permanent outdoor Improvements on a Lot if the Improvements are visible from other Lots or from streets or Association common area. Prior written approval of the Design Review Committee must be obtained in accordance with Article V of the CC&Rs & the Design Guidelines, unless prohibited by the Board of Directors. Drainage: There will be no interference with or obstruction of the established surface drainage pattern(s) over any Lot in the Community, unless an adequate alternative provision is made for proper drainage with approval from the Design Review Committee. Temporary Buildings: No outbuilding, tent, shack, shed, or other temporary building or Improvement may be placed upon any portion of the Community, either temporarily or permanently, without the prior written consent of the Design Review Committee. No garage, carport, trailer, camper, motor home, recreation vehicle, or other vehicle may be used as a residence in the Community, either temporarily or permanently. Post-Tension Concrete Slabs: Owners will not cut into or otherwise tamper with the Post-Tension Slab, nor will they permit or allow any other persons to cut into or tamper with the Post-Tension Slab so long as the Owner owns any interest in the Residence. Owners will disclose the existence of the Post-Tension Slab to any Person who rents, leases, or purchases the residence from the Owner. Hello October! Fall is officially here and with it comes my favorite time of the year. I am very excited to be a part of the holiday season here at Solera Diamond Valley. The Recreation Committee and I have been working on the Solera Holiday Season for months and we have some fun and festive events coming your way. Celebrate Oktoberfest in Solera Style as we transform the Ballroom into a beer hall with baked potato bar, along with German and domestic beers. Join in on the fun as we will also have games, trivia and a pretzel eating contest. Bring out your best costumes to attend the Halloween Party and dance the night away with a Solera favorite, The Showdown Band! Sharpen your knives and paintbrushes for our pumpkin decorating and carving contest. We will also have a photo booth, games and signature drinks available for all to enjoy. Don't worry, your favorite four legged furry friends won't be left out of the fun, make sure to join us on the Back Patio for our Dog Costume Contest. Don't have a dog? We need voters!
