SOLERA DIAMOND VALLEY | DECEMBER 2018 5 HOLIDAY HOME TOUR The tour will be Saturday, December 8, 1 – 3:30 pm. We need homeowners to open their holiday-decorated homes for our Holiday Home Tour. The tour this year is two weeks after Thanksgiving, that will give you more time to decorate your home. Please consider having your home on the tour. We have had many types of décor, not just Christmas. If you celebrate Hanukkah we would love to see your home. Please keep in mind we must have a minimum of six homes to tour. This is a community of over 500 homes. We would like to have eight homes. Decorating for the holidays is hard work, but a lot of fun to do and see. Those wishing to tour will need to sign up at the Front Desk. The last day to sign up to tour homes is Wednesday, December 5. You might think about talking to your neighbors and friends about putting their home on the tour. CHRISTMAS CART CAROLING Join us Tuesday, December 11 at 4 pm for an evening of holiday cheer as SDV residents gather for our annual Christmas cart caroling. All participants are welcome to gather in the Lodge parking lot at 4 pm. Residents who would like carolers to sing to them, look for the caroling signs in your area. SDV LIFESTYLE TRAVEL PRESENTATION Join us Tuesday, January 10 at 2 pm in the Lodge Ballroom for this unique travel presentation. We invite all cruisers to join us and learn about some amazing group cruises that are on the horizon. All group cruises will come with port and/or airport transfers from Solera as well as a host who will accompany the group. See Richard Booth to sign up if you would like to attend. Upcoming in Solera Diamond Valley Dear Homeowner,- This letter is to introduce myself and my firm, and to inform you about a matter that we're pursuing on behalf of your association. My name is Christopher Coglianese, of Dicks & Coglianese. I'm a licensed attorney in California, Arizona and Florida, and have been representing homeowners in construction defect actions for over 20 years. I was contacted by your general counsel and Board of Directors earlier this year to investigate ongoing water leaks, mold and other issues at the clubhouse building, as well as to perform a statute of limitations analysis. I was given to understand that the original developer and contractor, Pulte and Eleven Western, had previously been contacted with repairs requested on numerous occasions, and ultimately declined to assist. The Board's primary concern, apart from having the leaks stopped and the building repaired, was ensuring that the Associations legal rights be preserved. Upon review of the documents, it was determined that indeed the ten year statute of limitations for these types of claims was due to expire in July of this year. As a result, and given the history of leaks and other problems with the building, the decision was made to immediately file both a statutory Notice of Claim, and a formal lawsuit prior to that deadline. This both preserved the Association's claim, and any claim that Pulte may have against its subcontractors. Having preserved all claims, I met with Pulte's counsel, and we agreed to formally 'stay' the lawsuit with the Superior Court, while we explore the most cost-efficient collective approach within the context of the relevant 'Right to Repair' statutes. These statutes are designed to explore resolution without the time and expense typically associated with traditional litigation. We've agreed on a 'road map' for this process which includes a joint site inspection between Pulte and its consultants and the Association and its consultants (already completed) as well as joinder of the relevant subcontractors (in-process) and joint invasive testing to better identify the true nature of the problems (currently in discussions re scope of the testing). Once the testing is completed the results will be shared among the parties and consultants to explore whether a consensus repair may be achieved either through direct discussions or with the assistance of a mediator. We expect the duration of this process to be about six months. Given the limited nature of this statutory process, costs incurred in pursuing the claims, though ongoing, will be similarly limited. Moreover, the Association will seek reimbursement for any and all such costs and they will be made part of the Associations claims against Pulte, et al.
