14 | THE COLONY NEWS | OCTOBER 2021 | HOA NEWS (e) A Decorative Accessory must not be attached to or hung from rain gutters, trellises, lattices, light fixtures, windows, sliders, shutters, garage doors, roofs, vent tubes on roofs, chimneys, roofs of patio covers, arches at the front of the residence over the front porch or entry way, the wall above garages or a neighbor's residence. (f ) A Decorative Accessory may be placed in a niche over the garage door (if there is one), however, it may not exceed the width and depth of the bottom ledge of the niche. (g) If the proposed Decorative Accessory is a flowerpot, flower basket or similar decorative pot, it must be maintained with either live plants or commercial grade artificial plants (UV resistant and non-fading). (h) If the proposed Decorative Accessory is a wreath, 1 such wreath may be located on each half of the front entry gate (if it is a double gate) and 1 wreath may be located on each of the front doors (if it is a double door) and each wreath shall not exceed 24 inches in diameter. (i) The Decorative Accessory must be removable and must not involve any structural changes to the residence, wall or fence and must be located inside of the front gate (or front entry way if the residence does not have a front gate) of a residence. Colors should complement the color scheme of the residence as set forth below. (j) Decorative Accessories may not be placed on the top of any wall or fence except as otherwise provided for in the ACC guidelines. 1.2 Home Improvement Application. A Home Improvement Application must be completed and submitted to the Architectural Control Committee (ACC) before installation of the Decorative Accessory. 1.2.1 The application shall include at a minimum the following: (a) A color photograph of the Decorative Accessory and the dimensions. (b) The color of and the material used to make the Decorative Accessory (i.e., copper, metal, wood, ceramic or other similar material). (c) A color photograph of the residence that has a diagram/sketch drawn on the photograph showing exactly where the Decorative Accessory is to be installed and the method of installation. 1.2.2 After the ACC has received the application, it will be scheduled on the regular agenda along with all other applications. The ACC will review the application and schedule a site visit to the applicant's residence (if deemed necessary) to review the color of the residence, the location where it is being proposed for installation and how the Decorative Accessory will blend and coordinate with the exterior color and architecture of the home. It is the intent of the ACC that Decorative Accessories be used only as a complementary accent to the exterior of the residence and that it will not be the primary focus of attention. 1.2.3 Not all exterior colors and designs of the residences in The Colony lend themselves to the particular Decorative Accessory requested for installation, inasmuch as they must be both architecturally and aesthetically pleasing and at the same time blend in with the exterior architecture of the surrounding residences. 1.2.4 Each application will be evaluated individually, and a decision will be made on a case-by-case basis. A Decorative Accessory that may be approved on the exterior of one residence may not be approved on the exterior of another residence, due to the exterior design features of the residence itself such as color, pop-outs, corners, windows, pillars, archways, etc. In accordance with Civil Code #4360, Rule Making Procedures, these proposed rules and revisions are presented for member review. Please provide, in writing, any comments or questions you may have regarding these proposed rules and revisions to the Board of Directors within 30 days of receipt of this publication.
