include the two walkways leading from the driveway to both the front entrance gate and the side yard gate (if applicable). (c) The same footprint of both the existing driveway and walkways must be used. (d) No personalized designs such as emblems, initials, monograms, crests, etc. are allowed. (e) No loose material is allowed. (f ) If sand mortar is used, a polymeric additive (or equivalent) must also be used to prevent any erosion. (g) No grass may be used on either the driveway or walkways. 22.1.4 After the ACC has received the application it will be scheduled on the regular agenda along with all other applications. The committee will review the application and schedule a site visit to the applicant's home, if necessary, to review the color and type of material, where it is being proposed for installation, pattern and design and how the material will blend and coordinate with the exterior color and model of the home, roof tiles and the color and pattern of any existing driveway or walkways to remain. It is the intent of the ACC that the changes to driveways and walkways must be used as a complementary accent to the exterior of the home. 22.1.5 Not all exteriors and configurations of the homes in The Colony lend themselves to the application of all the materials described above in a way that will be both architecturally and aesthetically pleasing and at the same time blend in with the exterior architecture of the surrounding homes. 22.1.6 Each application will be evaluated individually, and a decision will be made on a case-by-case basis. What may be suitable on the driveway and walkways of one home may not be suitable on the driveway and walkways of another home, due to the exterior color and design features of the home and the existing landscaping. 22.1.7 Depending on where the installation will occur, the removal and/or relocation of plants, ground cover, above ground and below ground irrigation, below ground electrical, below ground gas, below ground utilities, or any other items or materials that are either above or below ground may be necessary, all at the expense of the homeowner. If any relocation as described in this Article is required, the homeowner shall file an application with the Landscape Maintenance Department for their approval. If the Landscape Maintenance Department determines it is necessary, they will make one or more interim inspections during the construction. Similarly, even if no relocation is required of any plants, ground cover or above or below ground materials, any damage that may occur to any of the items described in this Article or anything else on the property during installation is the responsibility of the homeowner and shall be repaired at the homeowner's sole cost. 22.1.8 If there is an existing sewer drain or any other type of "cleanout" drain on either the driveway or walkways, they shall not be removed or relocated and must remain as is and be incorporated into the design and remain accessible at all times. ***NOTE: ALL COSTS WILL BE AT THE HOMEOWNERS EXPENSE*** PROPOSED DECORATIVE ACCESSORIES RULES 1.1 Exterior Decorative Accessories 1.1.1 Decorative Accessories are defined as: a) wall mounted items attached by either hanging or fixed mounting, made of copper, metal, wood, ceramic, or other similar material that are attached to either the i) front, side, or rear of an exterior wall of a residence; ii) to a pillar; or to a fence or wall between residences. 1.1.2 Decorative Accessories must comply with the following guidelines: (a) Decorative Accessories must be installed flat against the exterior stucco wall of the residence or pillar, and cannot be hung by chain, wire, rope, string or any other similar hanging material. No Decorative Accessory can be attached to either the back wrought iron fence or the wrought iron return if it is visible from the common area. (b) Each Decorative Accessory must not exceed a total of 1,764 square inches (i.e., 42" x 42"), and can be any shape (i.e., round, square, rectangle, etc.). If more than 1 Decorative Accessory is requested to be installed on an exterior wall of the residence or fence or wall between residences, the collective total size of all such Decorative Accessories must also not exceed a total of 1,764 square inches. For purposes of installing Decorative Accessories, a residence is considered to have only 3 walls—front, back and 1 side. Nothing can be installed on the side gate garage wall. A zero-lot line residence is considered to have only 3 walls—front, back and the side on which the front door is located. (c) The maximum number of Decorative Accessories on any one exterior wall of the residence or on any exterior fence or wall between residences, shall be limited to 4 only, and cannot collectively exceed a total of 1,764 square inches. If the Decorative Accessory is not visible from common areas, this limitation shall not apply. (d) The width of a Decorative Accessory installed on a pillar must not exceed the width of the pillar and the height cannot exceed twice the size of the width. Only 1 pillar may have a Decorative Accessory installed to it and front pillars (near or attached to the front entry gate) cannot have any Decorative Accessory attached to it.
