After 11 months of Planning Commission meetings, City Council
meetings, attorney consultations, etc. the fight against the Banning
Point warehouse development continues to move forward. As a
group, the Pass Action Group Board of Directors continues to be
amazed at the support of those in Sun Lakes and the surrounding
community. This is and will continue to be a team effort.
Hopefully, many of you were able to attend our Town Hall last
month and were able to hear from our lawyer, Kevin Bundy. Kevin
has been doing an outstanding job on our case.
By the time of this publication, we should have received the
Administrative Record on our case from the city of Banning and the
Developers. As you may know, this is all the information in their
combined records that are related to this case.
Our law firm, Shute, Mihaly & Weinberger, will review these
documents with the Pass Action Group legal committee to confirm
we have received all information related to our case. The next steps
in process should be as follows:
1. After reviews, the city of Banning will certify the Administrative
Record.
2. Our team will submit an opening brief to the court.
3. City of Banning/developers will be filing an opposition brief.
4. Our team will submit a reply brief to the court.
5. Judge Craig Riemer will set a hearing date.
As has been outlined, there are many procedures to follow and this
will take months before we get to a hearing. More details will follow
as we are updated.
The P.A.G. will be having a Fiesta FunRaiser social event and
fundraiser at the Sun Lakes North Clubhouse on Mon., Oct. 24 from 5
to 9 pm. Along with food from Tacos & Beer, entertainment, auctions,
and door prizes will also be on tap. Approximately 80 tickets will be
sold and available to purchase until Oct. 17. Tickets are $40 each. You
may write checks to Pass Action Group and drop at 1816 Rivera Ave
in Sun Lakes. See notice on page 7.
