The following proposed Rules and Regulations were approved by the Board of Directors at the Oct. 20 General Board Meeting for 30-Day Member Comment to be voted on at the Regular Session in November 2022. The affected rules are printed below. Text that is removed is indicated with a strike through. All new information is in bold and underlined. Article 15.4 Fences 15.4 Fences. Any fence, gate or wall (regardless of the type of material) (a) must not be built against another wall, adjacent residence or other structure, and (b) must have sufficient clearance from the other wall, adjacent residence or other structure such that access is available for painting, repair and maintenance. 15.4.1 Wrought Iron Fencing. Alterations made to the wrought iron fencing installed by the developers is not permitted, with the exception that, instead of the return being the original wrought iron, the replacement return can be made from either vinyl, wood, stucco wall or block wall. However, if the replacement return is not wrought iron, it must match the existing fence to which it is attached (i.e., if the existing fence to which the replacement return is attached is wood, then the replacement return must also be wood) and must also be the same height as the original return. Backyard wrought iron, tubular steel, or aluminum are similar products for the purposes of these Architectural Standards and shall be painted black. All such fencing repairs, maintenance and substitutions of material must be with ACC approval. If any portion of the fencing being replaced is shared with a neighbor or neighbors, all parties involved must submit an architectural application in accordance with the CC&R's, Section 3.3, Easements for Party Fences Between Lots, that states, "There shall be an easement appurtenant to the Lots for any party fences or walls placed on the boundary between two Lots during original construction of the Community ("Party Fence"), regardless of whether such Party Fences are located precisely upon the boundary separating two (2) Residential Lots. Those Owners, who have a Party Fence which adjoins their Lots and effectively creates a boundary line between such Lots, shall equally have the right to use such Party Fence, except that each shall have the exclusive rights to use the interior surface of the Party Fence facing his Residence. Neither Owner shall drive nails, screws, bolts or other objects more than halfway through any common Party Fence, interfere with the adjacent Owners Use and enjoyment of the Party Fence, or impair in any way, the structural integrity of the Party Fence. In the event that any portion of such Party Fence, except the interior surface of one (1) side, is damaged or injured from any cause, other than the act or negligence of either party, it shall be repaired or rebuilt at their joint expense. 15.4.2 Mesh Barriers. Mesh barriers are allowed on back, front, and side fences and gates with ACC approval. The mesh barriers on the back, front, and side fences and gates are allowed to add security for small pets and to keep pests out. The mesh can be plastic or metal. This mesh must be the same color to match the color of the existing fence or gate to which it is attached and cannot exceed the height of the gate or fence. The mesh must be attached on the inside of such fence or gate and fastened with "zip ties" or the equivalent that are the color of the mesh. All such fencing repairs, maintenance and substitutions of material must be with ACC approval. Article 17 Painting Procedures 17.1 Submission for Architectural Control Committee Review Homeowners desiring to paint the exterior of their home shall submit a completed "Application for Painting Approval" form, available in the Homeowners Association Office (HOA). 17.2 Color Scheme Selection. 17.2.1 Only the current approved exterior color schemes can be used. No previous approved color books or original "builder" colors can be utilized. The approved exterior color schemes are shown in "The Colony at California Oaks Paint Book," available in the HOA office. A Paint Book may be checked out of the office upon submission of the required deposit. Paint sample cards for colors depicted in the current color schemes are available in the HOA office and are large enough to be used by the electronic color mixing instruments found at local paint vendors. This enables local painting contractors to buy the proper colored paint from their normal supplier. 17.2.2 Color schemes are to be used in accordance with the following: (a) Stucco, trim and accent colors are grouped in each scheme as associated colors. (b) Scheme colors may not be interchanged with colors shown in other schemes. (c) Accent colors are optional, not required. (d) A white from the White Option page may be used as a trim or accent with any of the stucco colors. (e) If white from the White Option page is chosen as a stucco color, a trim and/or accent color from any of the paired schemes may be selected. (f ) Stucco must be painted with a flat, eggshell, or satin paint. Semi-gloss and gloss paint are not allowed. Trim and accent colors may be painted using a satin finish. (g) Garage doors may be painted the stucco color, the trim color or a white from the White Option page. (h) Two coats of paint are required, using a known brand such as Sherwin Williams, Vista, Valspar, Behr, Olympic, etc. 17.3 Definitions 17.3.1 STUCCO refers to the main body. 17.3.2 TRIM refers to fascia, relief pieces, stucco pop-outs, around windows, wood trim around garage doors, cap on stucco walls, planter shelves and front doors.
