8 | THE COLONY NEWS | MAY 2023 | e following proposed Rules and Regulations revision was approved by the Board of Directors at the March 14, 2023, General Board Meeting for 30-Day Member Comment: Article 17 Painting Procedures, 17.2 Color Scheme Selection, 17.2.2 (f ) Stucco must be painted with a flat or eggshell paint. Satin, semi- gloss, and gloss paint are not allowed on the stucco. Trim and accent colors may be painted using a flat, eggshell or satin finish. In accordance with Civil Code #4360, Rule Making Procedures, these proposed rule revisions are presented for member review. Please provide, in writing, any comments or questions you may have regarding these revisions to the Board of Directors within 30 days of this receipt. Just a friendly reminder to all who are now enjoying the sunshine with their dogs within The Colony. The Covenants, Conditions and Restrictions (CC&Rs) for The Colony at California Oaks have restrictions associated with "Pets and Maintenance of Animals within the Community" (See Article 10, Section 10.18, beginning at page 48). These restrictions apply to all owners. Further, it is the responsibility of all landlords to communicate these restrictions to tenants with pets who rent property within The Colony. Non-compliance may result in Violations being issued to homeowners. Animal control violations may result in fines; possible removal of pet; and possible suspension of community privileges. (See page 22 of The Colony Rules and Regulations – "Animal Control Rules.") In summary: • Pick up after your dog! • Dogs are to be kept on a leash at all times when being walked; and • Walking your dog or letting him or her loose on golf course property is not allowed at any time. The following is the exact language in the CC&Rs, Article 10: 10.18: Pets and Maintenance of Animals Within the Community. No one may keep pets or other animals in violation of the following: 10.18.1: No animals of any kind shall be raised, bred or kept in any Lot or in the Common Area, except that common household pets, including dogs or cats, may be kept in each Lot: provided, however, that no animals shall be kept, bred or maintained for any commercial purpose of in unreasonable numbers. As used herein, "unreasonable numbers" shall ordinarily mean more than two (2) animals per Lot. 10.18.2: Each Owner shall be responsible for cleaning up any excrement or other unclean or unsanitary condition caused by said animal on any Lot in the Community and/or the Common Area. 10.18.3: The Association, upon the approval of a majority of the Board, shall have the right to prohibit maintenance of any animal within the Community which constitutes a private nuisance to any other person. Every person bringing an animal upon or keeping an animal in the Community shall be liable pursuant to the laws of the State of California to each and all persons for any injury or damage to persons or property caused by such animal. 10.18.4: All animals maintained in a Lot must be kept either within an enclosure, yard or patio, or on a leash being held by a person capable of controlling the animal. 10.18.5: Association, its Board, officers, employees and agents shall have no liability to any Owner, their family members, guests, invitees, tenants and contract purchasers, or any other person in the Community, for any damage or injury to persons or property caused by any pet absent any willful or wanton negligence on the part of Association, or its Board, officers, employees and agents.
