The court case involving the City of Banning, Creation Equality
and the Pass Action Group (PAG) is still scheduled for Nov. 17, 2023.
The judge in this case has been changed to Judge Harold W. Hopp
instead of Judge Riemer. Judge Hopp has been on the bench since
he was appointed by California Governor Arnold Schwarzenegger in
2005.
Judge Hopp has been reelected several times since his appointment
by Governor Schwarzenegger, and has heard many civil cases
including complex CEQA cases such as the case filed by the PAG.
On June 25, there was a Pass Action Group Town Hall held in the
Sun Lakes Ballroom. Attendees were given information regarding
the PAG case and the current financial position of PAG. The financial
position is strong, but in the event of an appeal, additional funds will
be needed. Donations continue to be accepted.
In the event PAG prevails in some of their causes, they may be
assisted with current legislation. AB 1000 and AB 1748 are working
their way through committees. It currently looks like AB 1748 will
make it out of committee to the full assembly. AB 1748 is the weaker
of the two bills in relation to the PAG case, so it may be helpful.
AB 1000 is a bill that would require a 1,000 foot buffer zone
throughout the State of California for warehouses. This bill has died
in committee so far.
AB 1748 requires a 500-foot buffer zone for buildings over 400,000
square feet and this bill only affects Riverside County and San
Bernardino County. PAG is very hopeful for the passage of this bill.
More information on AB 1748 as it proceeds forward hopefully in
time for the court case that is pending.
