e following proposed new Rules and Regulations were approved by the Board of Directors at the August 17, 2023 General Board Meeting for 28-Day Member Comment: Changes are in red. ARTICLE 5, SECTION 5.4 ESTATE SALES (a) Scheduling. e homeowner or an authorized agent may hold one estate sale per year per residence. An estate sale is a sale or auction to dispose of a substantial portion of the personal property owned by a person or persons who are recently deceased or being moved to a permanent care facility and will not be returning to their home. e home must be vacated by the current resident/residents prior to the disposal of such property. e owner or agent must obtain authorization for the estate sale from the Homeowners Association (HOA) office at least three (3) days prior to the intended date of the sale. An administrative fee of $250 is required at the time an application is submitted. A request for alternate estate sale dates may be needed due to other scheduled estate sales or Colony events. A maximum of two (2) consecutive days, or two sets of two (2) consecutive days, within a ten (10) day period, is allowed for the estate sale. Hours allowed for the estate sale are between 8 am and 3 pm only. Applications for an Estate Sale Authorization are available from the HOA office. (b) By Appointment Only. Due to traffic, parking, and vehicle considerations, Estate Sales are open to non-residents by appointment only. A maximum of five (5) non-resident vehicles coming for the estate sale are allowed entry through the Main Gate every 15 minutes. At least one day prior to the estate sale, the owner or agent for the estate sale shall provide a guest list to the HOA office of those who have been given an appointment time. A Schedule of Appointments form is available from the HOA office for use by the owner/ agent in charge of the estate sale. If no guest list is provided to the HOA office, all vehicles coming for the estate sale will be turned away at the Main Gate. Appointments for Colony residents are optional but encouraged. (c) Signage/Advertisement. Only one (1) "Estate Sale" sign is permitted at the residence of the sale. No signage is allowed in any other area of the community. e maximum sign size is six (6) square feet (example: 2'x3'). No banners, balloons, or other marketing devices, or materials that detract from the appearance of e Colony are permitted. Following approval of the estate sale by the HOA, announcement of the estate sale may be posted on the Clubhouse bulletin board. Signage size restrictions may apply. (d) Parking. e homeowner or authorized agent, or a representative of an Estate Sales Company conducting the estate sale, shall be onsite during the duration of the sale, at the location where the estate sale is taking place. Parking is only allowed in guest parking designated areas and must be consistent with all Department of Motor Vehicle laws. All guests must have their passes displayed on their dashboard and must abide by all driving and parking rules of e Colony. Parking shall not impede/interfere with another homeowner's garage or driveway on the street where the estate sale is taking place. (e) Sale Day. e estate sale must take place inside the home and garage. No estate sale items are permitted on the front yard or driveway. e garage door may be opened for loading or unloading only. e event shall keep noise to a minimum so as not to disturb neighbors. e owner/agent operating the estate sale shall be held liable for any damage to property that the Association maintains resulting from the sale and its vendors and/or customers. (f ) Licensing/Bonding Requirements. e estate sale company that is operating the sale must provide a copy, to the HOA Management Company, of their business license and proof they are bonded. is documentation must be submitted to the HOA at the time the Application for an Estate Sale Authorization is submitted. ARTICLE 17 PAINTING PROCEDURES 17.1 Submission for Architectural Control Committee Review. Homeowners desiring to paint the exterior of their home shall submit a completed "Application for Painting Approval" form, available in the Homeowners Association Office (HOA). 17.2 Color Scheme Selection. 17.2.1 Only the current approved exterior color schemes can be used. No previous approved color books or original "builder" colors can be utilized. e approved exterior color schemes are shown in "e Colony at California Oaks Paint Book," available in the HOA office. A paint book may be checked out of the office upon submission of the required deposit. Paint sample cards, for colors depicted in the current color schemes, are available in the HOA office. 17.2.2 Color schemes are to be used in accordance with the following: 17.2.2(a) Stucco, trim and accent colors are grouped in each scheme as associated colors. 17.2.2(b) Scheme colors may not be interchanged with colors shown in other schemes. 17.2.2(c) Accent colors are optional, not required. 17.2.2(d) If white from the White Option page is chosen as a stucco color, a trim and/or accent color, from any of Rules and Regulations Updated Continued on next page 12 | THE COLONY NEWS | OCTOBER 2023 |
