As of Oct. 1, 2023, we are approximately six weeks away from our hearing with Judge Harold Hopp, on Nov. 17, 2023. We have not received any information that would lead to a delay. As has been previously noted, Judge Hopp will review the administrative record. During the hearing, Judge Hopp will speak with attorneys representing all parties regarding any questions or additional information. We do not expect that any witnesses will be called, as you would see in a criminal case. The leadership of the Pass Action Group is hoping to be able to be in the court room for the hearing. At the time of this writing, we do not yet have word if we will be able to do so. During the recent Music Under the Stars social event, we had some t-shirts which were sold along with some amazing desserts. We also held a bean bag toss competition. It was nice for the Pass Action Group leadership to be able to talk to supporters in a relaxed atmosphere while listening to Elixir playing on the Veranda. We have procured some more of the necessary t-shirt sizes. If you are interested in purchasing a shirt or two contact Randy Robbins via text or phone call at (909) 499-3570. The cost is $20 per shirt. Dorrie Gartzke is continuing to collect recyclables on behalf of the Pass Action Group. To date, Ms. Gartzke has donated over $11,000 through this program which she initiated. Recyclables can be dropped at Dorrie's house, 6029 Spanish Trail Cove. Her phone number is (909) 562-9226. Thank you Dorrie! Over the last six months or so we have seen a continued shift in the warehousing industry throughout the country and in the Inland Empire. Per a Wall Street Journal article dated Aug. 10, 2023, there is a 3.8 percent vacancy rate in current warehouses in the Inland Empire. This number by itself may not seem that large but considering one year ago, the rate was 1.2 percent. Some of the increase is related to warehouses coming online that do not have any tenants. There are numerous warehouse projects still being built that may have trouble finding tenants. Should part of a victory require a "do-over" of the entire process, it is our hope that the city and developers may realize that efficiency and necessity of the Banning Point warehouse is questioned.
