PROPOSED RULE CHANGE #13-006: Rule changes concerning Pet Rules and Regulations The Board reviewed the following proposed amendment, to the Sun Lakes Country Club Homeowners Association General Statement of Rules and Regulations that appear in the Association's 2013 Local Phone Book, Sun Lakes Edition (reference page 19), at its Sept. 19, open session meeting. The Board will vote upon the proposed amendment at its Jan. 16, 2014 Open Session Meeting, following publication. If the Board votes in favor of the proposed rule change it would go into effect Feb. 1, 2014. Changes are reflected in bold, italic and underlined print. PETS 1. Household pets may be kept for pleasure/companionship purposes provided the animals are not a nuisance to surrounding neighbors and/or the community at large. A nuisance, for the purpose of this restriction, is defined as a disruption of a resident's peaceful enjoyment of either their or own or common area property. 2. All pets (including cats) must be kept under the owner(s) direct control and leashed at all times when outside the owner's residence. 3. Owners are responsible for picking up after their pets. Owners The Board of Directors is pleased to announce that the Association has settled the construction-defect lawsuit entitled Sun Lakes Country Club Homeowners Association vs. Pulte Home Corporation, et al., Riverside County Superior Court Case No. RIC 1101899. The subject of that lawsuit was damages to the common area. The suit alleged the developer's construction of inadequate common area storm-drain improvements at the south end of Sun Lakes. The total settlement compensation to be paid to the Association is $600,000. A general description of the defects are responsible for disposing of their pet's waste (defecation) in a proper trash receptacle at their residence. 4. Pets are not permitted in clubhouse facilities or on the golf courses. 5. Residents may have up to two (2) domestic pets at their residence. 6. Residents experiencing problems with neighborhood pets should contact the administration office. 7. All dogs are to wear identification tags and/or have a chip inserted. 8. If a dog is picked up by community patrol or a homeowner and cannot be identified, it will be turned over to EPAP Animal Rescue. If the owner is later located, he or she may be fined $25 and charged a $5 per day maintenance fee after a duly noticed hearing by the Safety and Security Advisory Committee. Dog will be relinquished only when owner proves that the dog is properly identified. 9. If the owner is not located within thirty (30) days, the dog, at the discretion of EPAP Animal Rescue, may be offered for adoption or turned over Beaumont Animal Control. Lawsuit Settled that the Association, as of the above date, reasonably believes will be repaired, corrected or otherwise addressed is: storm-drainage defects at the south end of the project related to runoff from the steep hillside above Breckenridge Avenue. The Association does not anticipate performing any repairs to any other common areas that were noted in its preliminary list of defects. The Association's good faith estimate as of this date is that the work required to address defects described above should be completed on or about the end of December, 2013. The foregoing is only an estimate. Please note that the Association may amend the above disclosures, including the identification of the defects that will be repaired and the estimated date that the defect repairs will be completed. Finally, the Board of Directors thanks the Association's membership for its patience and support during the course of this case.
