I am sure it will be full of wonderful days and nights where the residents of Sun Lakes will continue to be active and enjoy the many facilities and activities we have here. Prior to getting into the primary topic of this month's message I want to acknowledge the wonderful job of holiday decorating that was done in the Main Clubhouse. Sue Miller, Connie Froehle, and Linda Massey did a spectacular job. Everything was beautiful. One issue that is being brought up constantly relates to age restrictions for living in Sun Lakes. Article XIII of the CC&Rs, Age Restrictions, says "the Sun Lakes Country Club community has been developed as a senior adult residential community. Each residence must be occupied by at least one resident 55 years of age or older (the qualifying resident). All other residents must be at least 45 years of age or older or meet one of the statutory exceptions to the minimum age limit." Most people do not have a problem understanding the basic rule as it is stated above. What becomes confusing to many is the "or meet one of the statutory exceptions to the minimum age limit." It is important to know that this subject falls under California Civil Codes, the H.O.P.A. Act, and the UNRUH Act. There is a difference between a Qualifying resident and a Qualified resident. A Qualifying resident means a person 55 years of age or older. A Qualified Permanent resident is a person who meets both of the following requirements: 1) was residing with a Qualifying resident prior to the death, hospitalization, or other prolonged absence of, or the dissolution of marriage with, the qualifying resident; 2) was 45 years of age or older, or was a spouse, cohabitant, or person providing primary physical or economic support to the Qualifying resident. In addition, a Qualified Permanent resident can be a disabled person or person with a disabling illness or injury who is a child or grandchild of the senior citizen or Qualified Permanent resident as described above who need to live with the senior citizen or Qualified Permanent resident because of a disabling condition, illness, or injury. Permitted Health Care residents. These are people hired to provide live-in, long-term, or terminal health care to a Qualifying resident, or a family member of the Qualifying resident providing that care. The care provided by the Permitted Health Care resident must be substantial in nature and must provide either assistance with necessary daily activities or medical treatment, or both. Permitted Health Care residents are entitled to continue his/her occupancy, residency, or use of the dwelling unit as a permitted resident in the absence of the Qualifying resident from the dwelling unit only if both of the following are applicable: 1) the Qualifying resident became absent from the dwelling due to hospitalization or other necessary medical treatment and expects to return to his/ her residence within 90 days from the date the absence began; 2) the absent Qualifying resident, or their authorized representative, submits a written request to the Board of Directors stating that the Qualifying resident desires that the Permitted Health Care resident be allowed to remain in order to be present when the Qualifying resident returns. If it appears that the Qualifying resident will return within a period of time not to exceed an additional 90 days the Board of Directors, at its discretion, may grant an extension. Finally, it is important to know that upon the death or dissolution of marriage, or upon hospitalization, or other prolonged absence of the Qualifying resident, any Qualified Permanent resident shall be entitled to continue his/her occupancy, residency, or use of the dwelling unit as a permitted resident. I am not sure if I have clarified anything here or muddied the waters even more. The point to this message is that although we are a 55 and over community we do have many people legitimately living here that are under that age. If you have questions relating to a specific situation pertaining to this subject please do not accost or confront the resident. Instead, go to the Administration Office and discuss the matter with our Planning and Compliance Director, Heather Killian.
