A member commented that the Association needed to amend the CC&R's to allow solar panels within the community. The Association does allow the installation of solar panels on the homes and condominiums within the community, as long as the proper architectural application process is followed. California Civil Code §714 states that "Associations cannot (i) prohibit solar energy systems, (ii) impose restrictions that significantly increase their cost, or (iii) impose restrictions that significantly decrease their efficiency." Accordingly, Sun Lakes has been allowing the installation of solar systems for some time now. For more information please reference the General Statement of Rules and Regulations section 7.26 - Solar Energy. 2. A member commended on the proposed 2016 budget regarding solar, reserves and the bulk cable agreement. Question: Can an owner opt out of the bulk cable agreement? The answer is no, a member may not opt out as this fee is a contracted fee through the Association. 3. A member thanked his friends and family who came to the meeting to support him and his wife, during an appeal of a Master Architectural Committee ruling that pertained to artificial turf. September Open Session Board Action Items • The Board approved for publication a proposed rule change clarifying overnight parking of lessee's in the RV lot. • The Board approved the renewal of the Time Warner Bulk Cable Agreement. • The Board approved a rule change addressing the 6 in 60 rule in the RV parking lot. • The Board approved a request from the San Gorgonio Memorial Hospital Foundation to sponsor their upcoming golf tournament. • The Board approved a request from the Banning Community Fund to hold a breakfast event at Sun Lakes in November. • The Board approved a recommendation from the Marketing Advisory Committee pertaining to the 2016 marketing budget. • The Board approved a request from the Sun Lakes Marines and Friends Club to change their status from club to group due to a down turn in participation. • The Board approved for publication and member comment an architectural change allowing garage doors to be left ajar (no more than 1 foot) during daylight hours for ventilation purposes. • The Board approved the appointment of George Dexter to the Finance Advisory Committee with a term beginning in January 2016 and concluding in December, 2017. • The Board approved three different member appeals to Master Architectural Committee rulings pertaining to artificial turf. • The Board approved the recommendation to publish for member comment, an architectural change pertaining to artificial turf recommended standards. • The Board approved a request from the San Gorgonio Memorial Hospital Foundation to host a town hall at Sun Lakes in 2016 pertaining to the proposed new hospital funding measures. • The Board approved a request from the Lady Niners for a variance, to the "no denim" rule on the golf course for a one- day golf tournament that has a 50's theme. • The Board discussed with the membership a proposed solar project at Sun Lakes that could have long lasting benefits for years to come. • The Board discussed what procedures will be in place for the implementation of the new traffic photo speed trailer. • The Board answered a question from the Bingo Advisory Committee concerning proceeds and handling of funds. • The Board approved a recommendation from the Recreation Advisory Committee to install "No Outside Alcohol Allowed" signs around the Main Clubhouse. • The Board discussed the proposed new shops located across Sun Lakes Blvd. • The Board approved to initiate intent to lien/lien letters for delinquent property owners. September Report on Executive Session Action (non-confidential) • The Board of Directors held an Executive Session Board meeting on Sept. 3, at 1:30 pm and Sept. 17, at 1:30 pm at which time litigation, member discipline, formation of contracts, and personnel matters were discussed. • The Board instructed legal counsel on certain litigation, potential litigation, and assessment of related matters. • The Board received and considered legal advice on litigation and potential litigation issues. • The Board received a refund request for an annual golf membership. After careful consideration, the Board voted to approve the refund request. • The Board reviewed and discussed emergency preparedness proposals, costs and ideas if the El Nino' rains were to hit the community. • The Board reviewed and discussed a proposal for a solar farm on Sun Lakes Property. Workshops are currently being setup for the community to hear about the project and dates will be announced soon. • The Board held a Member Show Cause Hearing. • The Board received three proposals for the repair of the South Clubhouse wrought iron and stucco wall. After careful review, the Board approved the project and selected the low bidders, JL Fence and American Eagle, for a cost not to exceed $15,000. This is a reserve item, and the money for this repair will come from the reserve account. • The Board reviewed the Ad Hoc Committee report and costs associated with the distribution to the community. • The Board received proposals for drainage engineering for the Championship Golf Course. After reviewing the proposals carefully, the board decided to table the project pending further discussion with the city of Beaumont. By Jeremy Wilson, General Manager IN-HOME SAFETY CHECKS Daylight Savings time is a good time to change the batteries in your smoke alarms and carbon monoxide detectors. Make sure to check the alarms and install new batteries. Check and replace any home fire extinguishers that have expired. PERSONAL SAFETY Use extra caution when climbing ladders for projects such as cleaning gutters or hanging holiday decorations and changing smoke alarm batteries. Shoes or boots may be wet causing you to slip as you climb the ladder. We highly suggest using your favorite handyman or maintenance contractor for battery changes or any work requiring a ladder. Keep your driveway and walkway clear of falling leaves; they get very slippery when wet.
