| SUN LAKES LIFESTYLES | NOVEMBER 2017 | 9 Proposed Rule Change Notification 17-09 The Board reviewed the following proposed amendment, to the Sun Lakes Country Club Homeowners Rules and Regulations (revised July 2017 edition), that appear on the Association's website (www.sunlakescc.com) and are available in the administration office (please reference Article X – Rights of Enforcement) at its Sept. 27, 2017 Open Session Meeting. The Board will vote upon the proposed amendment at its Jan. 24, 2018 Open Session Meeting, following publication in the November edition of Lifestyles. If the Board votes in favor of the proposed rule change it would go into effect Feb. 1, 2018. Notice, informing the members of the approval, would be posted in the Main, North and South Clubhouses, in agreement with Civil Code § 4045. PURPOSE: Reduce confusion for members who obtain a parking citation in Sun Lakes. EFFECT: Provide residents with a better understanding of the parking and citation enforcement process utilized at Sun Lakes. Strikethrough = Text to be deleted Bold, Italic and Underlined Text = Text to be added PROPOSED RULE CHANGE Article X – Rights of Enforcement Section 10.03 Parking and Citation Enforcement Parking citations are addressed according to a ninety (90) day cycle from the first citation issued. If no additional parking citations are received within 90 days of the first citation issued, the enforcement schedule is reset. The schedule of enforcement for Parking Citations are as follows: 1st offense – Violation Notice 2nd offense (within 90 days of first offense) – Violation Notice 3rd offense and all subsequent offence (within 90 days of first offense) – Scheduling of a Disciplinary Hearing before the Safety and Security Advisory Committee. After a disciplinary hearing has been conducted, the Safety Advisory Committee has the authority to impose compliance fines for each violation in amounts no greater than what is reflected in the Sun Lakes Rules and Regulations enforcement schedule outlined in Article X – Rights of Enforcement, Section 10.02 Violation and Fine Schedule. The Safety Advisory Committee may also forward the matter to the Master Board of Directors for additional action, which may include daily fines, suspension of voting privileges and/ or community facility use privileges. Once the Safety and Security Advisory Committee holds a hearing, and has reached a decision, the owner and/or resident involved will be notified of the Committees findings by mail. If a fine has been issued for a violation, the total amount will be due within thirty (30) days from the date of the hearing. If the amount is not received by the stipulated due date, and no action of appeal has been initiated, the fine amount will be placed on the homeowner's assessment account.
