| SUN LAKES LIFESTYLES | DECEMBER 2017 | 3 By Sandra Moyer FROM THE PRESIDENT'S DESK TOWN HALL SUMMARY: The Board held two Town Hall meetings addressing the Board of Equalization issue. We had around 350 residents attend and voice their thoughts, concerns, and solutions. The following is a brief summary of the Power Point presented: Sun Lakes was audited in March and April then notified in May that tax is due from 2013-2016 based on our alcohol pours and cost of food. BOE looks at invoices for alcohol and food, then determines, based on "industry averages," if the amount of income reported is the same as BOE's calculations. • Sun Lakes management responded in June. We identified areas within the audit that were incorrect and voiced concerns with the methodology used. BOE returned in July to review the disputed areas and did not accept our concerns. They stated we owe $168k in taxes. • August, Sun Lakes Board engaged a tax attorney who has dealt with the BOE – he too contested BOE's tax determination, but BOE again did not accept his arguments. • BOE finalizes audit on Oct. 19 and submits report to the State of California. State of California will bill Sun Lakes for the presumed tax owed. Sun Lakes has 30 days from receipt of letter to appeal. Our attorney and staff are preparing for that appeal process. • The Board has several options: a) Pay the tax and close the case. b) If the appeal fails, continue to fight. c) Work to find a settlement amount and prepare for future audits. • Consensus from the attending residents was to pay the alleged amount under protest, try to reach a settlement, and get procedures in place for any future audits. The Board will make a final decision and present it at a future open Board Meeting.
