Two agents from the California Department of Alcoholic Beverage Control visited Sun Lakes Country Club in September, after they had received a call that gambling was taking place in one of our club/group events. During the visit, the agents informed the Board and management that any gambling, including 50/50, raffles, or opportunity drawings are against the California law and considered a misdemeanor. In addition to the legal ramifications, the Association can receive fines up to $6,000 and ultimately lose the Association's liquor license if any further actions are found. The Master Board of Directors would like to let the residents, district delegates, club/group members, and sub-associations know that organizations in the community are not allowed to host ANY games of chance which include gambling, 50/50 raffles, or games played for money. The Board has zero tolerance for this type of activity at your event. The only organization that can legally host a raffle, per California law, is a charitable trust. Our community has the Sun Lakes Charitable Trust, which hosts Charity Week each year, and they are the only eligible organization (at this time) able to host a raffle. To be in compliance, a charitable trust has to register the raffle event with the Department of Justice. Furthermore, the function has to meet the 90/10 rule where 90 percent of the gross receipts generated by the sale of raffle tickets are to be used for charitable purposes, and 10 percent are used to pay for expenses or operating costs. The Association will work in conjunction with the Sun Lakes Charitable Trust to ensure we meet all the necessary requirements. Now, I am sure you are asking…. what is allowed then? Below is a list of allowable suggestions that could be considered by your organization (please remember this is not an exhaustive list, and we can always add to it in the future). This list is simply meant to be a guide when your organization is planning your events to keep them within the limits of the California law. 1. If your organization is in need of fund raising to support your events, hold a silent auction. Silent auctions are a great way to raise dollars and are within the legal limits. 2. Your organization might consider raising your annual membership dues to supplement the budget for your functions. 3. Prizes for games of skill are allowed. Games of skill might include a sports tournament, a chess match, or a contest like "closest to the pin" in golf. Games of skill are activities that solely depend upon physical and/or mental ability without any element of chance and/or randomness of winners. 4. Finally, door prizes are allowed as long as a member does not have to purchase a ticket for the chance to win, and all members of the gathering have the same opportunity. The association has been warned and is not looking to have any further consequences regarding this matter. The Board is reaching out to you and the rest of the community for assistance in assuring that your organization is doing the right thing. If there are any specific questions in regards to an activity your organization runs, please call the admin. office at 769-6649, and we will do our best to help clarify. Games of Chance in Sun Lakes Country Club ATTENTION ALL HOMEOWNERS: Insert in this month's Lifestyles MUST be filled out and returned by 3 pm on Fri., Dec. 15 Beginning this year, California Civil Code §4041 was passed which addresses member contact information for the Association. This legislation requires homeowner associations to send a separate document to each homeowner (not tenants or non-owner occupants) on an annual basis, to obtain the following information: 1. The address(es) to which notices from the association are to be delivered. 2. An alternate or secondary address. 3. The name and address of your legal representative, if any, including any person with power of attorney or other person who can be contacted in the event of the owner's extended absence from the home. 4. Whether your home is owner-occupied, rented, or vacant. As a result, the Association has included this in the December Lifestyles as an insert; please look for the separate sheet of paper in your copy. If you do not receive one, copies are available in the administration office or on the Sun Lakes website (sunlakescc.com). The Association asks that you read this document, fill it out, and return it to the administration office no later than 3 pm, on Fri., Dec.15. If an owner does not return the form, by the date specified, the property and/or secondary addresses, currently on file, will be deemed the addresses to which notices are to be delivered. | SUN LAKES LIFESTYLES | DECEMBER 2017 | 5
