10 | THE COLONY NEWS | MAY 2022 | HOA NEWS Recommended Rule Revisions The following proposed Architectural Standards and Guidelines were approved by the Board of Directors at the March 17, 2022 General Board Meeting for 30-Day Member Comment, to be voted on at the Regular Session in May 2022. The affected rules are printed below. Text that is removed is indicated with a strike through. All new information is in bold and underlined. ARTICLE 15 – HOME IMPROVEMENT AND DESIGN 15.6 Gazebos and Arbors. Gazebos, Arbors and Trellis Panels. Gazebos or similar freestanding structures will be individually reviewed by the ACC. They will not be allowed in or near the front of the residence. Maximum height of a gazebo may not exceed twelve (12) feet and arbors may not exceed eight (8) feet. The square footage of the structure and lot will be carefully evaluated to achieve a reasonable balance in the yard area. Light, airy roofs are recommended. Colors must be harmonious and submitted with the request for approval. 15.6.1 Gazebos are defined as a roofed structure, typically round or octagonal, that offers an open view of the surrounding area. Gazebos can be made out of wood, vinyl or metal. No fabric or canvas or similar material is allowed. Gazebos are only allowed to be installed in the backyard. There can only be one (1) gazebo per lot and it cannot exceed twelve (12) feet in height. The roof of a gazebo can be solid or have an open spaced framework. The color of the gazebo must be only one color. No two- tone colors are allowed. The color must be compatible with the paint scheme of the home. 15.6.2 Arbors are defined as an archway with a roof formed by trained climbing plants over a framework that can be made out of wood, vinyl or metal. No fabric or canvas or similar material is allowed. Arbors are allowed to be installed anywhere on the lot. There can only be two (2) arbors per lot and the arbor cannot exceed eight (8) feet in height. All arbors must be installed behind the front yard or side yard entry gate. Arbors cannot be installed outside the gates on the front yard property. The color of the arbor must be only one color. No two tone colors are allowed. The color must be color compatible with the paint scheme of the home. 15.6.3 Trellis Panels are defined as a frame that is used as a support for climbing plants or vines and can be made out of wood, vinyl or metal. No fabric or canvas or similar material is allowed. Trellis Panels may be installed in the front yard, side yard or back yard of the home. If the trellis panel is attached to the home or a fence or a wall, the color of the trellis panel must be color compatible with the paint scheme of the home, fence or wall to which it is attached. Trellis panels cannot be attached to wrought iron fences. Trellis Panels cannot exceed the height of the front yard, side yard or back yard fence to which it is attached or located. If the Trellis Panel is attached to or located next to the stucco of the home it cannot exceed eight (8) feet in height. Only two (2) trellises can be installed on a lot if the trellis can be seen from the common areas. 15.6.4 No Decorative Accessory can be affixed to, hung from, or in any other manner attached to a gazebo, arbor or trellis panel. 15.6.5 A Home Improvement Application must be completed and submitted to the Architectural Control Committee (ACC) before installation of A gazebo, arbor, or trellis panel. The application shall include the following: (a) A color photograph of a sample of the gazebo, arbor or trellis panel and all dimensions (height, width and length). (b) The color of and the material used to make the gazebo, arbor or trellis panel. (c) A color photograph of the residence that has a diagram/sketch drawn on the photograph showing exactly where the gazebo, arbor or trellis panel is to be installed. 15.6.6 After the ACC has received the application, it will be scheduled on the regular agenda along with all other applications. The ACC will review the application and schedule a site visit to the applicant's residence (if deemed necessary) to review the color of the residence, the location where it is being proposed for installation and how the it will blend and coordinate with the exterior color and architecture of the home. 15.6.7 Each application will be evaluated individually and a decision will be made on a case-by-case basis. A gazebo, arbor or trellis panel that may be approved for one residence may not be approved for another residence, due to the lot size of the residence or the size of the area where the gazebo, arbor or trellis panel is proposed for installation. The square footage of the proposed gazebo, arbor or trellis panel will be carefully evaluated to achieve a reasonable balance in the yard area. 15.18 Lattice and Trellis Panels. Lattice Work. Prefabricated lattice (a woven pattern) is readily available at local building material stores and may only be added to the wrought iron backyard fence or to the front entry gate for
